1400 H-1B Visa 2010 Applications Denied?

During last H1B Cap Count Update on June 1, 2009 it looked like this

  • H1B General Quota – 45,800 H-1B cap-subject
  • Advanced Degree Cap – 20,000

H1B Cap Update June 5, 2009

As of latest update on June 5 it looks like this

  • H1B General Quota – 44,400 H-1B cap-subject
  • Advanced Degree Cap – 20,000

Difference in 1 Week – 1,400 H1B Petitions (may be denied, revoked, or withdrawn). Advanced Degree H1 Cap remains the same.

With Case status online not working properly, what do you think? Is it good or bad news?

Hii..My H1B was rejected by legal Department shall i apply again with same consultancy or other one please advice,I spent US$4000 with that consultancy

If my Sister has applied for a green card for me, which I presume will take 10-12 years for processing. Meanwhile, if i get a job, which require’s me to travel to USA on H1B visa, Would I still be eligible to apply for H1B Visa?. Would my application for Green Card by my family member disqualify me for H1B Visa. Since Green Card Application is an Immigrant Visa and H1B Visa is a non-Immigration Visa. Could anyone help me out with this query?

there is nothing like this , u can apply for h1b visa even ur sister has filed ur papers but while filing form ds156 do not hide this from consulate, pl mention the true things.

Good daY. I have an H1b Visa Issued last Aug. 2008. Unfortunately i was not able to use because of one big family problem most concern on finances and health. Now that its almost Ok I still have the H1b visa ok until 2011 of september. My question is can I still go to US and use the same H1B Visa safely? Anyone please help.

Hii..My H1B was denied this year (got to know yesterday)…it was denied last year as well..I did file for MTR last year..but it did not work..So should I appeal for Motion to Reopen again this year?? I have already spent $7000 in total…and I am confused and dejected…

Can I apply again this year through another employer..as the quota is still open??

@p : U can have more than 1 h1b ; i dont think there is a problem in filing a new h1b if u got denial on ur previous one.

To all folks who’s application got denied: My application was also denined, but my employer filed for MTR (Motion to Reopen/Reconsider) and after 7 weeks, USCIS approved my petition.
The moral of the story is if your employer has sufficient documentation, USCIS has no reason to deny the petition.

Have faith in GOD and try again with all the possible evidences on which the denial notice was sent.

Hello! I have a problem with my receipt number given by my employer. Every time I check my status online it says “Your case can not be found at this time in Case Status Online. Please check your receipt number and try again.” I emailed my employer regarding this, and she told me that it’s natural bec. some of the applications are not updated in the USCIS online. I’m wondering with her responsed, she said the company filed my application April 1, 2009 but still no update. Anyone here has the same problem with me? thanks!

Hi,
my employer(Consultant) got a rfe from USCIS for details abt my future employment and withdrew the application as i am now on H4 visa and do not have any confirmed employment.Is this rfe query random or are they doing it for all applicants? What can i do next ?

MY H1b application got denied… i spent 3,300 for filing and 1500 for attys fees… is the filing fe refundable if i got denied? whats my best move now? to refile or to appeal? my lawyer said if i appeal i have to wait 8-10 mos for approval… i cant wait that long… Im an RN BSN on F1 visa now in the USA… what is the best move for me now.. thank you… what could be the reason for my denial… thank you

@ pyotrfeldman…how and when did u find out that your h1b petition was denied? do you have master’s degree/clinical experience in a specialized field?…im also BSN RN and im quite worried now that i about ur case.

no masters… just experienced…. i have met someone from new york a 2008 grad from phils… at the time she filed her h1b… she still didnt have the nclex and didnt have expereience at all… she just passed nclex this june… but yet she got approved… thats why im wondering what went wrong with my application… cuz 5k usd is a big sum of money… Theyre saying that its a matter of luck… to whoever consul will your papers get through

@ sai…i think it’s a dialysis company…i was filed @ CA service center…no decision yet…what’s ur case stat?..i thought nursing homes are not allowed to sponsor nurses for H1B?

amy ; i know there are nurses wking in nursing homes on h1b ; but chances are less to get approved unless the position should be supervisor and they have to prove bsn is the min requirement for the position.

USCIS cannot reject your petition without any reason.. Also Home Health ? ( Nursing home / care home ) @ wht designation.

for hospitals i know tht it will get approve for sure; but for nursing home it depends. Try to find a hospital tht sponsor h1b. Also check for hospitals in nd they need bachelors degree for nurses.

filing fees are non refundable even if your case has been rejected.

I was having same question after my attorney send out RFE for 2 weeks, but three days ago, my status was updated. So, just be patient, they surly are updating your status.

umm, I am not quiet sure about this since I am still waiting also. According to the USCIS, they will response to you within 60 days, I guess, it won’t spend that long.

I got the H1B approval notice almost 2 months back but USCIS website was showing “Case received and Pending” until 16th July!! So dont worry abt the online messege. It seems that it is not being updated on a regular basis..
