Bill To Restrict H1B Hiring to All Companies?

After new H1B hiring restrictions was signed into law as part of Stimulus Bill,  companies receiving stimulus money have stricter rules to hire H1B workers for the next 2 years. Recently Bank of America canceled job offers to MBA Graduates requiring H1B Visa sponsorship. There is been huge debate going on about this new law.

New H1B Bill to Restrict Hiring – All Companies

Even before the heat of that matter is resolved, new bill is expected to be submitted into Senate that will make hiring H1B Visa workers tough. And this new bill is expected to extend the list from TARP companies to all firms applying to hire H1B workers. Details of the bill be known in coming week.

That would make hiring H1B workers by any companies as difficult as TARP companies. It’s expected to be introduced into senate this week. USCIS will be accepting H1B Visa petitions from today to next 4 business days, till April 7, 2009.

But, it will be long ways from being approved in Senate, house then signed into law. But, if this bill is introduced into congress, it will heat up the H1B Debate again. While we get more information in coming week, our blog readers voted to forecast number of petitions USCIS would receive for H1B Visa Cap 2010 in poll that was closed yesterday and if 60% of voters were to be true, then USCIS will conduct mini-lottery to select H1B Visa Petitions, which is much better than random lottery for entire H1B Visa petitions received.

  1. I know of one IT manager who makes over 1 million dollars annually by bringing over indian it professionals and falsifying their resumes. He nets $30 per hour per employee between what he bills the company and what he pays the workers. I as well as many of my IT friends have been replaced by these unqualified workers. Due to his greediness, many American IT pros are losing their houses and health insurance. Is this right ???

  2. Everything happens for a reason folks. If the US doesn’t accept immigrants anymore, I am sure if you are trul capable you will be able to make your american dream somewhere else. If the US keeps turning immigrants away, it would become a 3rd world nation in 2 decades. Would you like to live in a 3rd world country?

    I doubt it you do. I won’t.

    This bill will not get an approval. Because there are so many benefits from new comers / H1b holders to USA.The Government knows it better than anyone else. without knowing this the people are shouting at us. May be some drama I guess.

    1. Every genuine visa holder pays a tax.
    2. we help US in their pension policies and ssn policies.
    3. New settlers means new business to the locals. Even from door mat to bed and car to slipper we buy everything here.
    4.we are just coming with 2 suitcase. only one person in the family is working to feed the wife and kids. (H4 visa holder cannot work, but can study. so again a revenue to the country).
    5. our kids study here, pay money for education , school lunch and stationery.Again we are spending here.
    6. The visa holder rents an apartment , again there is revenue to the US.
    7.If we buy house / car , again there is flow of money.
    8. If we travel to work by public transit , then again there is flow of a lot of money.
    9. I am very sure we all eat, drink and entertain in this country , giving them a lot of money flow. Tourism also getting flourished by us. (Have a look at Niagara in Summer, we can see only other nationals there).
    10. We can never see a visa holder without health insurance. we pay for health insurance regularly and give business to this nation.
    11. Even if we use an emergency service we are billed heavily.
    12. Look at the stores like walmart, Ikea and Target. who is buying the major household things? Again there is business to these stores by us. Who is running / working there? Locals.
    13.Who is paying for the car insurance regularly? The legal immigrants.
    14. If we have to go back to our homeland, we have no choice but going again with only 2 suitcase, leaving behind everything on a cheap sale or donate them. Again the profit goes to the locals.
    15. If we live with a very tight schedule and poor spending habits , then we can save a meager amount of 1/5 th of what we earn. That is also impossible if there are 2 kids.

    After reading all of the above can any one hate an immigrant. America is formed by immigrants and it will definitely grow with immigration. When we discuss the above said points to any businessman in this nation, then they will accept it, while others cannot understand. So don’t believe this rumor.

      you points are very weak and funny. your “spending money” is based on the TARP companies laying off American workers. If the Americans can’t even get a job, why the American laws are thinking of taking advantages from immigrants? Yes, you pay taxes, but so do Americans.

      I am pretty sure the bill will become a law soon.

    I cannot believe whats happening.. They first let all of us in when the economy is doing bad so that they can increase revenue.. and now when they are in deep shit.. they are literally asking us in so many words to get out..
    I cannot believe this.
    Well I think this will affect this years lottery as well.. as no one is even willing to sponsor a work visa.. and how do they expect you to get a job? I t is like a double edged sword. If you have a job, then the damn lottery will take place and you wouldn;t know whether you will or will not get through. And if you don’t have a job offer, then you cannot file a h1!! How are people like me, who earnestly wants to work, work??? go back to India???
    The whole process is being done on whim and is a BIG MESSS!!!

    Will this new law of restricting all companies (even those that have not received any stimulus money) to hire H-1B workers affect this year’s H-1B hiring process? Since it is mentioned in this article that the bill will take some time to become a law, will USCIS hold on to all applications until it becomes a law before processing them…anyone got any views on this situation? Desi consulting firms with questionable credibility hiring under or barely qualified so called ‘professionals’ and marketting them to do jobs that’s way over their head – sooner or later the show was going to end, and here it is. Because of such irresponsible people everyone has to bear the consequences.

    Congratulations to ALL CONSULTANTS!!! i really wana pay trebute to all desi consulting firms who have created such a beautifull MESS for last few years tht atlast US Congress and Senate thinking to shutt H1-b programs. THIS IS OUR DESI ATTITUDE who always have let us down!!!!!!

      would anybody tell me what is this mini lottery . If the cap does not reach within upto 7th April,09 for FY 2010 H1b petions, then why mini lottery. All who make petition should get approved his petition.

      Random lottery is ok as in the case of last year FY 2009 when more than 1.90 lac applciations were recevied during the first two days. What is this mini lottery if applciations are not sufficient during the first seven days. Pl explain.

      Rest as per article, I am not hope that it will go through in the Sentate that the hiring restrictions shall be imposed on all the companies irrespective of Stimuls/TARP favoured one companies. I am doubtful that the bill may not go through since there would be lot of debate.
