What does Case Received and Pending mean?

Good to see many are getting their H1B Visa Receipt numbers. But, the comments so far shows, many are not clear about what is “Case Received and Pending’.

When your H1B application is selected in the lottery, USCIS will send a receipt number that will uniquely identify your case ( your H1B Visa application). Here is the list of services available when your status is ‘Case Received and Pending’

H1B Status – Case Received and Pending?

During last year FY2009, there were many readers who were asking about the status of H1B Visa approval. Even in April/2009 there are few cases under RFE, which is the next stage of Case received and pending, if there is any query. If you are still not sure what does that mean – here is my explanation/understanding of  ’Case Received and Pending’ status.

  • First, your H1B visa application is selected in lottery.
  • USCIS will issue receipt number to identify and track your H1B visa processing status.
  • It will take usually 2-3 months to approve your H1B visa petition. If you have applied through Premium processing ( by paying additional $1000), after H1B petition is selected under lottery, within 2-3 weeks, USCIS will approve your H1B Visa application and send hardcopy Form I-797 H1B approval notice. Form I-797 is the official approval notice that will serve as the proof of H1B approval. You will use I797 while appearing for Visa interview.
  • If you have submitted H1B visa application through regular processing then USCIS will take 2-4 months to verify your documents and your credentials and send the H1B approval I-797.
  • If you receive the I-797 H1B approval before that, you should feel lucky. So, if your H1B status shows, Case Received and pending, you got H1b Visa – Congrats. Here’s an detailed description of different ways available to check H1B visa processing times.

    I applied for H1b visa through an employer. Got receipt number by Apr 23, 2009. Still the online status it says case received and pending. I am worried.
    Now I wish to apply again through another employer.

    My doubt is :
    How long will USCIS continue to accept H1B applications for 2010?
    Will they stop accepting after OCT 1st or do they still accept until the quota finishes?

    I have a question and hoping someone will give me advise. My H1B was received april 20, 2009 under vermont service center until now my status is still pending and I called my lawyer that He still didnt receive any approval nor RFE.. Would you think is it advisable to pay 1000 dollars to have it premium processing or do i just have to wait at least before october for the result. Thank you very much.

    Not finding your Case Status Online?

    The United States Citizenship and Immigration Service (USCIS) National Benefits Center (NBC) Liaison Committee has identified that there is a problem with the interface tool for the “Case Status Online.” Not only has this problem caused much delay in the recording of new receipt numbers in the system, it has hampered the updating of status information for those cases already in the online system. The Liaison Committee stated that the issue was not limited to NBC filings, and that the problem has been recurring. The NBC Liaison Committee did not provide a time estimate of when they expected the interface to be fixed.

    My case also says “request additional documents”. My employer has sent additional documents long time back but still no answer. I applied in May 2008. Did anyone got approval after such a long time?? Please comment.

      My case is still “case received and pending”, Is the status of any of u have changed? Is there any luck? What r ur plans then?

        Mine is still “case received and pending”, I got my receipt on may 4th. Till now my status is same. Applied under Vermont center.

    My status is still case recieved and pending. The Employer is under scrutiny.
    In this case would i be permitted to apply for H1 2009 quota in April. Irrespective of previous case staus is it allowed to file new applcation ?

    My friend submitted H1 visa transfer for almost 15months back for one of the employers but the status is “Case Received and Pending” (fortunately he didn’t took up the employment with them).
    Why USCIS take such a long waiting time and for what information they are waiting for?
    Are there any legal procedure to move this case up to get some solution?
    If some one answer those questions will really helpful for many of them.

    Hi,

    My case is still pending …came to know that the Employer is under scrutiny by US govenement. What to do…der is no rejection also and approval ke to koi chances nahi dikh rahe hai ..it is 17th nov.
    What should be course of action..can I contact UCIS .

    Will they will rejection or result for the case before April ..

    Kindly guide in this regards

    I got H1B receipt number in the 2nd week of May and still my status is “Case received and Pending” and my employer got no approval or decline forms. Its already second week of October ….. when can I expect the approval papers or the change of status to Approved..?..or..only waiting is the solution..?

    Even my case was picked in lottery around mid May, and its still pending. Ask your employer whether he/she has received any communication.

    Some times it can still be pending…while a approval/decline notice sent.

    Other than waiting we have any option.
