Hi friends, I like to share my visa experience which was a road to USA with three speed breaks and joining with a smooth road and ultimately a first step towards a new journey.

Hi everyone. I got a low score on the TOEFL (72), I got a conditional admission from North Carolina Agriculture and Technical State University because I did not achieve the minimum TOEFL score of 79. I am required to take an English As a Second Language course while I take 6 credits at the university.

Anyone have any f1 visa interview experience/tips for conditional admission because of low TOEFL score?

You have couple of options

  1. Attend F1 Visa Interview with conditional admission.
  2. Te-take TOEFL before the interview, improve the score and get New I-20

Due to Boston Bombings few weeks back, there are new changes at U.S. port of entry. News is reported in NAFSA and reproduced here.

Based on news accounts, and preliminary contact with the Department of Homeland Security (DHS), it appears that DHS is instituting an interim policy of referring arriving F, M, and J non-immigrants to secondary inspection, to ensure that individuals whose SEVIS records have been terminated are not readmitted without a thorough review of the students’ situation. f1 interview bachelorsFollowing F1 Visa interview experience is shared by Kashif.

I reach the consulate 8.45 for my 9am interview. After the security checks I was let in and made to sit in a queue.

I advise other students to reach the consulate early for this. After some time we where led into the building and given a token number.

We followed the queue to get our fingerprints verified and I sat in the first row in the waiting area for my interview.

I saw many interviews in my 90 mins wait time. A male officer on a particular counter was issuing visas to almost everybody and a lady was rejecting almost every applicant.

I got nervous seeing this. I was constantly praying that I got that generous officer.

I saw the ones who failed where those who hadn’t prepared properly and where didn’t have a proper plan.
Luckily I got the generous officer.

Me: Good Morning.
VO: No reply..Types into the computer.

VO: Good Morning Sir.
VO: Yes, I heard. Which degree?
Me:Mechanical Engineering

VO: Any other admits apart from UTA (University of Texas at Arlington)
Me:YES

VO:Which?
Me: SUNY, MSU, OSU & UTA

VO: hmmm. types into the computer.
VO: So you had gone to Saudi? Y?
Me: Hajj. It is…
VO (Interrupts): I know what that is..what is a generous smile. About to give the VISA, I could sense it.. But…
VO; So ready to go to Texas? Done with your high school this year?
Me: No. I completed two years back.. Here the grilling started (I wanted to be honest no matter what)

VO: What have you been doing since then?
Me: Told. Explained honestly looking into his eyes,

VO: Ok. So what is your father s income?
Me: 2.5 Lakhs p.a

VO: Mother s income.
Me: 6.25 Lakhs
As soon as he heard 6 lakhs he interrupted me:

VO: Your Visa has been approved and you will get it in 3-5 business days.

I reached home in 15 mins after the interview since I live near.

Within 4 hours I got an Email that my passport is ready for pickup.  I’ll be collecting it tomorrow morning since it was already Friday evening.

You must have read the quick summary of Comprehensive immigration Reform Bill (Sus congress logo.744).

One of the important section is Startup Visa provisions, which includes ability to get visa to USA to start a new company. Here is a detailed summary of Startup Visa Provisions.

The comprehensive immigration reform bill 2013 finally provides the long and anxiously awaited Startup Visa Act provisions.  Titled – Investing in New Venture, Entrepreneurial Startups and Technologies, the provisions include a non-immigrant visa category and an immigrant visa category.

A qualified entrepreneur can apply for this visa.  A qualified entrepreneur means:

  1. Has significant ownership in a US business
  2. Is employed in a senior executive position
  3. Submits a business plan to the USCIS, and
  4. Had a substantial role in the founding or early stage growth and development of such US business entity.

Invest Non-Immigrant Visa:

  • Initial admission for 3 years
  • May be renewed for an additional 3 years, if during the most recent 3 year period alien did the following:
    • Created at least 3 full-time jobs AND received $250,000 qualified investment.

OR,

  • Created at least 3full-time jobs AND during the 2 year period ending on the date extension applied for generated at least $200,000 annual revenue.
  • May obtain a renewal for up to 2 one-year periods for a waiver from the above if the alien has made substantial progress and that such renewal is economically beneficial to the US.

Invest Immigrant Visa: There are 2 types:

First

  • Must be qualified entrepreneur
  • Maintained valid non-immigrant status in the US for at least 2 years.
  • During the 3-year period ending on the date extension filed alien has
    • Significant ownership in a US business entity that has created at least 5 full-time jobs AND has received $500,000 qualified investment in the alien’s business.

OR,

  • Has significant ownership in US business that created at least 5 full-time jobs AND generated at least $750,000 annual revenue during the last 2 year period. AND, no more than 2 other aliens have  received non-immigrant invest visa status on the basis of alien’s ownership of such business.

Second

  • Must be qualified entrepreneur
  • Maintained valid non-immigrant status in the US for at least 3 years prior to filing for such status.
  • Holds an advanced STEM degree, AND
  • During the 3-year period ending on the date the alien files petition under this section:
    • Alien has significant ownership in US business that created at least 4 full-time jobs. AND received qualified investment of at least $500,000

OR,

  • Alien has significant ownership in US business that created at least 3 full-time jobs. AND during the 2-year period ending on such date generated at least $500,000.

At first reading, these provisions seem reasonable to me and I think will greatly benefit the US economy.  It does not restrict the type of business entity/industry.  There is no specified percentage of ownership in business.  There are definitions of certain terms and other important smaller details.  I will include them soon.

However, the Invest Non-Immigrant visa should be amended to dual intent visa. It appears that Non-immigrant Invest visa is 6 years (or 5 if they need a waiver) maximum. I would hope and guess that the intent of the senators might have been to have these people apply for the Invest Immigrant visa in due course (perhaps akin to L1A to EB1(3) multinational transfers).

Entrepreneurs get 10 points in merit-based assessemnt if they have at least 2 employees in zone 4 or 5.  Job zones are based on the ONET determination of how much preparation is required. Zone 5 requires the most preparation and 1 requires little/none. So, this would mean for entrepreneur to get 10 points, the jobs have to be what we currently call specialty occupations (H1b term).

As I read more and understand more, I will update this article. In the interim, the above provisions sum up a great addition to immigration reform.

P.S: This is a bill and bill to become a law  will take time and requires approval from U.S. Senate, Congress and Signature from the President.

breaking newsHere are couple of updates about H1B Visa 2014 Regular Processing Receipt Number.

USCIS has started the data entry process for H-1B petitions selected in the lottery. Data entry for non-premium processing cases will begin after the premium processing cases are entered, and rejection notices will follow after that.

Data entry of non-premium processing petitions will not be complete until at least May and perhaps June.  Rejection notices for petitions not selected in the lottery will be sent out after the data entry for winning petitions has been completed.  AILA points out that when the cap was reached on the first day in 2008, USCIS did not complete data entry and issue receipt notices until late in May 2008. My employer got the mail of h1b receipt notice today. I’m master quota, regular processing, in California Service Center.

On the receipt notice, the received date is April 8th, and the notice date is April 12th.

Good luck with those who haven’t receive the receipt notice.

If you haven’t received receipt notice, then don’t panic. Stay put. It can take upto June, 2013 5o get receipt notices.
