Hello,
I am not in the US currently and got a job offer from a company on 17th September. They filed for a change of status H1B on 14th Oct 2009.I have a OPT which started on 13th July.I just wanted to know if I am still eligible for the change of status as I am in India right now and because of the 90 day unemployment clause.

Thanks

Hello everyone! I'm very confuse at this point about how long does the OPT grace period will the INS gives you when you finish your Graduate degree here in the US.

>> OPT is valid for 12 Months.

I have heard many people said that the INS will give you 5 years to work here in the US after your graduate with your masters degree. Is that true?

>> No, it snot true.

If it does, am I still qualified for that? even I graduated my Bachelors here and granted a 1 year OPT which ended a few months ago. I'm going for my Graduate studies in a few months and needs some enlightenment regarding this.

>> Hope you are maintaining your legal status after your OPT is expired.

My understanding is that there is 60 days Grace Period after OPT Expiry date. But, you should not be unemployed for more than 90 days during your 12 month OPT period.

Read more about OPT and 90 days rule

Hi,

I need some advice quite urgently, my OPT will be expiring in two weeks and I am on the verge of securing a position with a company that could be interested in filing for me. I'm not sure that the decision will be made before my OPT expires, can they still file for me after the expiration date, and will I have to wait till Oct 1st to begin working if they do.

Thanks!

I work for a small non-profit and our immigration attorney filed the petition for me pro bono. It's quite difficult to get an answer out of him other than "You'll be fine". Very irritating. Anyway, this is a first for our company so we're feeling our way through this.

That link is great though thanks!
