FY2010 H1B Cap Cases – USCIS Issues Receipt by Mistake

USCIS is accepting H1B Visa Applications for FY2010 from April 1, 2009. Based on number of cases received, they have said, receipts will be issued only to petitions selected in lottery ( if there is lottery).

Murthy.com reports that USCIS issued Receipt numbers to small number of cases in Vermont Service Center.

Vermont Service Center (VSC) incorrectly issued receipt notices for some H1B FY2010 cap cases. It is expected that these receipts will be withdrawn. No one should rely upon a receipt issued during this initial timeframe.

But  there are no official updates from USICS about number of H1B Visa petitions received for FY2010.

Looks like someone who applied in last year lottery just got H1B denial notice after 1 year from USCIS. Already there is one mistake from USCIS, could there be more? When they process so many number of applications, something will go wrong.

Is there a new legislation being created which requires that for every H1B that the employers wants to bring to the US they have to show a new recruit who should be a US citizen? My application has been filed but my manager threw this googly today.

dude…you seem to be throwing numbers out there that make some sense – although I feel they are a bit inflated. My question is do you have any sense on advanced quota apps this year? Here’s my math – Last year they received 32k apps. 12k were unlucky. If 4k have lost their jobs/returned to India, that leaves 8k. I know the job percentage this year is 30-40% which gives us 13k apps. If you add them up, the total number of apps should be 18k. So it looks good. What do ya think?

I just heard the USCIS recieved the same number of apps as they did last year. Hows that possible? I thought there’s a freakin’ recession going on… Man..I hate these [xxxxxx - removed] consultants who screwed up the process… Good luck and God Bless to all those who have applied for H1 this year and HAVE A REAL JOB!!!

Well, this may be possible. For one, many of those people who didn’t get the H1B Visa last year are re-applying this year.

At the same time, however, I’ve spoken to 2 different immmigration law firms and they both mentioned a decrease in H1B Applications. They estimated about 30% less. Then again, I’m in the New York area, and this area has been hardest hit by the recession, so 30% seems like a reasonable decrease. I’m sure other areas have been less affected.

Perhaps we are about to enter the same lottery odds as last year, however I’m guessing only a slight improvement in the odds, but still a lottery… ;(

The 5 day deadline occurred. A USCIS spokeswoman told me that a press release will be made the day after the cap was met. She said she didn’t know if the cap has been met (It sounded like she said that with a smile :-) , but then she told me an official announcement is expected tomorrow on April 8th. I asked her if that means somebody at USCIS knows the cap has been reached, but unfortunately she saw that one coming and wouldn’t confirm or deny my question. Hey, I tried. LOL!

Are we all confused yet?

So, it sounds as if the USCIS will announce tomorrow that the cap has been reached, otherwise they probably wouldn’t be sending out a press release on the 8th. Based on the chart below, I am not too worried that my previous newsletter was wrong — it was just a day or two premature.

My company applied for my h1b for Apr 2009. I am currently working for a American Comany as a Business Soulution Developer. Hopefully i will get my h1b approved since its a real job not from any consultancy. Keeping my finger crossed.

I think nobody knows the answer yet… We will probably here by the end of this week, or early next week if they will be doing a lottery. I hope they don’t need to. If they do though, I hope they pick me! ;-)

I know you are excited….buts whats the point…why don’t you wait..if your case is genuine, and if you have a real job, you have nothing to worry about…and therez no URGENCY involved [:)]

Well, I am excited for the exact opposite reason dude. I just joined a software consultancy on OPT after graduating with a masters degree in electrical engineering from a US school in Summer 2008 and being ‘unemployed’ (i.e., only a part time internship, no proper job) since then.

The guy who runs the consultancy had offered me 45k and more importantly, told me that they will file for my H1 *THIS YEAR* as soon as I finish training and find a project because ‘the quota is expected to remain unfilled because no one is filing for new H1s this year’.

I wanted to know how much more bullshit he will attempt to feed me. He basically wants me to remain enslaved to him, working for a piddly 45k for a whole year or more (until October 2010 when (*if*) I can get my visa filed in April 2010) when he can bill my clients 70-80 dollars.

Yeah, you said it. I wish I could pursue the American dream with a degree of dignity and honesty. Unfortunately, it doesn’t seem that I and people like me will be able to do that.

So how long do you think the quotas will remain unfilled? Is there any hope for my employer filing for me in July/August?
