H1B 2010 Cap Count – 42,000 + 20,000

Well, yesterday USCIS announced that they received about 50% of General Quota and almost close to 20,000 H1B petitions under Advanced Degree Cap. There were some interesting discussions on H1B 2010 Cap Not Hit. USCIS through AILA reported that , today they have announced the official numbers.

  • General Category : ~42,000
  • Advanced Degree Cap : ~20,000

But, it  looks like they are still accepting H1b applications for both the category, since not all submitted applications will be approved.Stay tuned with HSB for more updates and do add your questions about H1B Visa Approval process, which will be answered in coming days.

Hello,
My firm has applied for H1B FY2010 on April. Well i do not have the application number with me as my employer has not shared it with me.
I am yet to receive any information about it. What is the last date to get a approval for visa interview? What i have heard is it generally happens b/w Aug and Sept. It was not premium processing either.

Did you find out the reason for rejection? Did you first get a RFE and then rejection or was it a direct rejection?

I got 2 RFEs on my h1b form ISCIS.
My lawyer is sayingthat special evaluation of wok is required .The h1b will get approved ..I am too sue about this .please help me

Bad News… Yes, of course you can re-apply. I suggest talk to you lawyer and try to find out reasons for rejection.

Yes, they did on April 27th. I re-checked with my employer and my cheques were in fact cashed.

Did you get your visa rejected or RFE? RFE means requesting something additional document? If you got RFE, then you can always submit those required documents can they will process it further.

Just to inform you that notices of approval have already been mailed. I tracked mine on the uscis website and thank God i have been approved. Hard work and determination and most importantly prayer pays off.

After you receive your I-797C Notice of Action ( Which everyone receives) on the top left hand corner there will be a receipt number begining with EAC……. You willl need this number to track your case status online of via phone. Online go to http://www.uscis.gov and look for a link to track case status. If you are already in the U.S like i am you can call Uscis give your receipt Number and get the most recent update.

I received the following update from USCIS (USCIS online update email notification):

Current Status: Request for Additional Evidence Sent

On April 13, 2009, we mailed a notice requesting additional evidence or information in this case I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, call 1-800-375-5283 to update your address.

Request for evidence is not necessarily bad USCIS just need additional documents showing eligibility.

This means that USCIS requires additional information for your case. Your H1B sponsor will have to act on this. Once the information is received then USCIS will re-open your case and review the same. It can go bad or good from there.

Even my case status is same: REQUEST FOR ADDITIONAL INFORMATION SENT. Iam just curious to know about your current status. Is everything ok now? Did your attorney submit the requested information as asked by the USCIS? And whts the additional information that the USCIS asked for?

Where is the question of lottery if the number of applications are far below the quota!!
No one wants to come to US these days! In a few years you will find Americans filing job applications in India!

My Application reached USCIS on April 1st. Now, USCIS only received 42,000 applications in first week. Does it mean all those 42,000 applications will be approved ? Thanks

These applications will be accepted. There is a difference, after acceptance the applications are subject adjudication. After your attorneys succeed the petition may be approved

No. It can still get rejected if it does not meet USCIS standards. The only good thing is that it will get reviewed. Unlike last year, if you were not lucky enough to be picked in the lottery, your application will immediately be denied even if it does meet USCIS standards.

Yes, I understand that the documentation needs to be complete for the application to get approved. Actually, I wanted to ask if anyone knows for sure if there will be a lottery for those who submitted there applications on or before April 7th. Everyone looks confused about it.

Per USCIS announcement dated 04/08/09, entitled “USCIS Continues to Accept FY 2010 H-1B Petitions”, it was clear to IMMIGRATION LAWYERS that there WON’T be a lottery for applications submitted on or before 04/07/09. I do emphasize immigration lawyers because the confusion seem to arise only from among us – the applicants. So if the lawyers say NO LOTTERY, then let’s just take their word for it. It is good news afterall.

I have a question regarding the quota and it’s applicable dates. For somebody applying in the 2010 quota if you get the approval notice in the next 10 days, can the visa be stamped immediately? Will the visa have a valid date from the day it is stamped or will the start date be 1-Oct-2009?

The next step is the h1b interview, if you get approved on that your start date will be oct/1

The visa will be stamped only after you pass the H1B interview. You cannot start working for the employer before 1st Oct 2010. The visa will be valid for 3 years.

Usually, even if you apply for visa in May/June/July and it is approved, the start date may not be more than 15-30 days from your employment start date. So if your employment start date is 1/Oct, your visa start date may not be earlier than 1-15/Sep.

I have been applying this since last two years however i did not get selected in the lottery. This time since the cap has not reached, what are my chances of getting the visa?

What is the approximate date of getting approval from USCIS? I have made application under regular case as i wasn’t aware of Premium processing!

Also does Education evaluation and Experience matter in getting approval? can any one talk about this? I have less then 2 years of experience. Does USCIS verify all these thing?

Incorrect information submitted, Insufficient evidence submitted, the employer recieved TARP assistance, background check was not acceptable–and the list goes on.

I agree, if the cap can be filled 12000 in a day. The sooner you get approved, the better. So, premium processing is kind of an advantage. I know that the premium processing case is start to be reviewed on April 7th, I can’t believe some one would got a notice of approval 2 days after that, not including letter shipping time.

Yes, my lawyer forwarded my an email from the USCIS about the approval. The I-797 approval notice will arrive by mail in about a week.

Yeah, it is possible that notice can be sent through email. My I-140 approval notice before was sent by the USCIS through email first.

Congrats, then! that was so quick. So, premium processing doesn’t have to be 15 days? Based on your experience, it can be earlier. :)

Did you apply from a big company? And with a Master’s Degree?

I’m working for a multi-national company with 1500+ employees in the US, and have an undergraduate degree.

They received my application on April 1st, and I submitted with Premium Processing… now playing the waiting game.

an interesting number. On April 8, regular only takes half of 65,000 (58,000 exclude Chile and Sg), which is about 30,000 ; and today regular already takes 42,000.

anyone has thought about it?

Premium processing only means that adjudication of a case is made in 15 days, provided no RFE is issued. However it does not mean that premium cases have a better chance than regular.

This is a release! My employer have applied for myu H1B again this year since my application didn’t make it to the lottery system last year. I’m on OPT extension and this is my last chance to get H1B. I’m in premium processing, so hoping that everything will be ok this time. Big Smile :D
