H1B 2010 – Cap Count Update – June 24, 2009

On June 24, 2009, the United States Citizenship and Immigration Service (USCIS) updated the count of received and counted towards the 65,000 cap. As of June 19, 2009, 44,500 H-1B cap subject non-immigrant visa petitions have been filed. USCIS has advised that they will continue to accept petitions until the cap is reached. Additionally, USCIS reported that they received 20,000 advanced degree H-1B petitions. Although the limit on advanced degree petitions is 20,000, past experience has tended to show that not all petitions received are approvable.

Accordingly, qualifying applicants are still able to petition for an H-1B nonimmigrant visa either under the general cap, or as an applicant with an advanced degree. (i.e., U.S. Master’s degree)

  • June 11, 2009 – 44, 400
  • June 24, 2009 – 44, 500

Previous Cap Count Update was on June 11, 2009 where 1,400 H-1B application were either denied, withdrawn or revoked.

    Hi,
    I have applied first time for H1-B under regular processing(65,000) but didn’t get Receipt no# till now.Do you know how many got their receipt nos yet. I am still waiting for my recipt no. and my employer also don’t have any information about this. Can anybody tell me whether USCIS has already dispatched all candidates Receipt nos./EAC nos. or I should wait some more. Is this delay happening because of employer’s reputation related issues or what. Whom should I contact besides employer. I really worried about it. Please somebody tell me about this.

    I got H1B stamped in Oct.2008.But I am waiting for the opportunity from my employer.As it is service industry they are waiting clients feedback.
    -Can I go to US on same visa n start searching the another employer/job?

    - N if I enter in US how many days I can stay without work on same visa?

    Hi…
    So, I got H1B approval notice from my recruiter already. But the case status online is still “processing”. The agency that I am working with is expected to send me the all the doc… I’m waiting for that.

    However, I have one question though. I am currently holding F1. Right now I’m looking for Full-Time position. What happens if I find the job and switch to work for that company before my H1B gets activated in late September. I’ve heard from my friend that at least I need to get’s it activated and get 2 pay-stub before I can transfer to other company. However, I’ve also heard that there is no need to wait till that time. Once we get the approval from USCIS, we can start switching right away… just that we need the new company to file the transfer for us.

    That’s what confuse me the most….
    Anyone who is clear on this matter?
    Response is really appreciated.
