H1B 2010 Cap Count Update – May 22, 2009

As of May 22, 2009, approximately 45,700 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

      The best time to go for visa stamping is ANYTIME.
      Once you have received all your documents and you are mentally ready for the interview… GO FOR IT.
      I got my approval letter from my company and i went on first week in July to get it stamped.
      The interview is different for everyone so i suggest you prepare for everything but have all the required documents in hand. Originals too.

    Hello folks…

    Just wanted to give people a heads-up that USCIS doesn’t keep their Case Status Online program very up-to-date…

    I have already received my H1B Approval Notice, however the following shows up when i check my Case Status Online:

    “Current Status: Request for Additional Evidence Sent”

    I received approval about a week ago (Notice Date May 20, 2009)

    I just wanted to let people know that the Online system is not 100% accurate…

    hi, may name is Joseph, i got denied of an H1B visa, the thing is im already here in the US thru my B1-B2. during the processing of my H1-b, i also applied for an extension of stay here in the US, w/c apparently has been denied at the same w/ the H-1b application?

    can i get deported for overstaying, thou my US visa expires on 2015.

      Joseph,
      A B1/B2 can be extended upto a maximum period of 6 months. The law states that once an extension is applied for, you may continue to be in the united states upto a max of 6 months (from arrival) OR your approval of the extension petition. If it gets denied, then you need to leave right away.

      You CANNOT stay in the US for a continuous period of more than 6 months in any circumstance on this visa.

      If you do so, you can be potentially barred from re-entering the United states again.

    Hi,

    I got the EAC reciept number but it has a typo error. Whenever I type the EAC number, it says that the number is invalid. I am not able to check my Visa status online because of the typo error. What does this implies? My attorney says to wait and watch. How to get the correct EAC number?
