H1B 2010 Updates

Every year H1B Visa season begins in the month of April. USCIS is accepting applications starting today April 1, 2009 for FY2010 which starts on October 1, 2009. H1B applications submitted last year haven’t been cleared yet. Most of them received RFE, but looks like it will be another busy year for USCIS to process all the applications.

H1B 2010 – Lottery?

Most of the immigration attorneys reported decrease in number of H1B Visa petitions they have processed compared to last year, but they all believe cap will be meet much before October 1, 2009. Almost all the employers should have submitted the applications yesterday or they should be sending it in a day or two.

Many will be having sleepless nights till USCIS say total number H1B visa applications received for FY2010. Hopefully they will inform in a day or 2 about the petitions, instead of waiting till next week. Since, TARP companies are not willing to file H1B Visa 2010, small companies can take advantage of this opportunity. Effect of the strict hiring rules passed will be know in couple of days. Certainly so many applicants are waiting to see if there is any update, but USCIS haven’t released any H1B 2010 cap details about petitions received on day 1.

Some H1B supporters don’t want to have any restrictions, but due to recession, many want to reduce the H1B 2010 cap, but any such move will take time. New bill have to be introduced approved in congress before it can be signed into law. Till then H1B 2010 quota will be 65,000 + 20,000.

I am Arjuna Rao from india, i am applyed H1 B visa in Oct 2009. so i am waiting for the approvel.can you tell me when it well approved. an my application status sowing “Req for evidence”, and my emplyer allredy he sends the reqire doctuments. can you guide me when it well approved.how much time it will take.

Ref to your abvoe article what is this RFE which has been quoted on the last year applcations for FY 2009 applcaitions by the USCIS. Tks for loading such valuable inforamtion by HSB.

I believe RFE stands for ‘Request For Evidence’ in case they want more solid proof about something.
