Can I Apply for H1B Visa 2009, While 2008 Application is Pending?

Last week Vermont Service Center released an update on pending H1B Visa applications submitted for FY2009 ( on April 2008). One of the reader had asked the following question
Hi all,
If VSC announce our H1B result on April 2009, then shall we apply for an another H1B in 1st april 2009 for this year. Will they accept our new application when the old H1B approval is pending.

If you read the update from VSC, they plan to process all the case before April, 1, 2009. So, you will be able to apply for H1B Visa again for Fiscal Year 2010. Make sure you talk to your employer and immigration attorney to understand the immigration related rules. I know its a long wait for remaining H1b petitions and some are not going to get Visa approval. So, I wish you guys good luck for another H1b season ( festive season??)

I have my H-1 transfer filed in May 2009 at california center. The case status still is pending and is awaiting backgroud check.
