H1B Denied! Approved after filing MTR

About 1400 H1B Petitions were either denied, revoked or withdrawn, but one of the reader got H-1B Visa petition approved after employer filed Motion to Reconsider (MTR) his H1B petition.

Comment @ 1400 H1B Visa Petitions Denied?

To all folks who’s application got denied: My application was also denined, but my employer filed for MTR (Motion to Reopen/Reconsider) and after 7 weeks, USCIS approved my petition.
The moral of the story is if your employer has sufficient documentation, USCIS has no reason to deny the petition.

Have faith in GOD and try again with all the possible evidences on which the denial notice was sent.

    Last years’ H1B denied, Filed MTR/Appeal on 28th July 2008, Got approval today 8th July 2009 after more than an year.Now my question is do i need to go for stamping as i have been out of country in Nov after filing MTR in July. Or do i get the I-94 with the aproval notice.

    well how many desi slave shops are going to be kind enough to file an MTR? many of them dont file for H1 in the first place.

      Hi,

      I have a peculiar problem. USCIS had sent RFE to my employer and we sent back all the documents mentioned in RFE. Within 2 weeks, I found the online status as denied. My employer received the denial notice and found out that we didnt answer all the RFE and then we (me and my employer) realized that the USCIS had sent only a 2 page RFE document instead of 3 and they missed the 2nd page and hence the denial notice. NOw my employer is gonna write to them in such a way that they accept my case and send the missing 2nd page to answer their RFE completely, but its totally upto USCIS discretion whether to consider or not. What you think of my case? Is it our fault that we overlooked the RFE document or USCIS’s mistake? im upset and also curious to know whats gonna happen :(
