H1B Visa 2010 Cap Count News Update – July 24, 2009

As of July 24, 2009, approximately 44,900 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.
Previous H1B Cap Count Update was on Jul 13, 2009, which had same H-1B count for General and Masters Quota. So, virtually no H1 Visa application was submitted between July 13, 2009 to July 24, 2009.

Hi!
I have an H1 B and my employer is a consulting company. However,
I haven’t worked for my employer as yet, as now I am into a
different career domain and wish to stick to this field
(Telecommunications).
As my employer cannot offer me a job in the Telecom field, can I
use my H1 B to transfer it to a company which does? I do not
have any paystubs too, can anyone answer my query?
I am interested to know a consultant as I wish to apply for H1B visa.
I have not been able to find an employer. Can anyone suggest me a reliable consultant? Thanks.

Hi, I was petitioned for H1B visa this year but still haven’t received any update from my lawyer and employer whether I got approved or not. Has the USCIS start the selection process even if the cap is not met yet? How long will it take before I know the result of H1B? Thanks

I do have a same query I got RFE as on date 21 May 2009 and it resumed on 2nd july 2009
Case Receipt No : EAC********
Date Applied: April 1, 2009
Regular or Premium Processing: Regular
Receipt Number Date: April 24, 2009
RFE Received on : May 21, 2009
RFE Case Resumed: July 02, 2009
Current Status: Current Status: Response to request for evidence received, and case processing has resumed
Here is the snapshot of RFE from USCIS:
Your company provides IT consulting and staffing service.The record does not establish where or for whom the beneficiary will work……….
Submit the itinerary of the work sites the beneficiary is assigned to, includes the specific dates, location and name of the each of the work sites where the beneficiary will work.
submit the letter from each work site, that identifies the name of the project the beneficiary is assigned to, the name of the vendor through whom the beneficiary’s service are provided and whether the work site has the ability to assign the beneficiary to a different employer………..
For each of the work site submit a letter from the business with ultimate control and authority over the beneficiary’s work. The letter must address the title and the duties of the beneficiary’s position, the minimum education required for the contracted position, The name and title of the primary person who supervise or will supervise the beneficiary at work site…..
My question is anyone has a same kind of RFE or is this type of RFE can get approval or how much time it takes to get approve
Pls respond to this query if someone have an idea .

Hi! I’ve been following this site since feb 09 and find you guys very helpful. Fortunately I got a h1b visa approval but my employer said that I cannot go to US this year and wouldn’t send my documents for visa interview and stamping because no job is currently available. What will happen to my visa? Please..need some views inorder to do my next step.

Hi Jovic! What was the job offered to you? Until when was the approval notice that you got? As far as I know, you can go for visa stamping within the dates specified in the approval notice. So, if economy picks up this fall, you’ll probably receive a go signal from your employer to go ahead for visa interview.
