[Breaking News] H1B Visa Cap for FY 2010 Reached

As of December 21, 2009, USCIS has received sufficient petitions to reach the statutory cap for FY2010.  USCIS has also received more than 20,000 H-1B petitions on behalf of persons exempt from the cap under the advanced degree exemption.  H1B Visa Cap 2010 Timelime Table – Updated

USCIS will reject cap-subject petitions for new H-1B specialty occupation workers seeking an employment start date in FY2010 that are received after December 21, 2009   USCIS will apply a computer-generated random selection process to all petitions that are subject to the cap and were received on December 21, 2009.

How long it will take to have a notice of recieved or rejected from USCIS? My application was sent a few days before Cap reached….

Hi Osiris,
my H1b was also sent for petition on 1st Dec 09 and till now I have not received any updates or receipt number. My employer is saying they will update me as soon as they get the receipt number. Its been more then 2 months my petition was filed.

as mine is same as ur case any info would help me a lot.

My lawyer has told me my petition was rejected due to Cap Reached.
He also told me he will be filling petition again in 3 weeks.

Is that possible to file a case for April 1st. before this date?

Hi all ,

My consultant has submitted my H1B application in the month May 2009, right now my application stats RFE state .. I am not sure why its getting this much delay .. Is there any Reason for this much delay ? , Do I need to get any info or submit any info to attorney ?
Please advise when this be processed and will it take this much time for processing ?

So I will be effected by this as my documentation was sent last week. Since we were expecting to get my H1B prior to getting my OPT started, I don’t know what to do. In addition to applying all over again, my OPT doesn’t start 45 days from now, what are my options? Can I file for a change of date to start earlier? Online status states my OPT application has been processed. My employer is in state of urgency to get me started?

So if my visa application is denied due to the cap, what does that mean for me? Do I just appeal it in Jan 2010 or do I have to go through the whole process again?

Yes, USCIS will refund if rejected due to Cap.
