How can I know if my H1B Visa has been selected or not?

I’m responding to one of the comment under H1B Visa 2009 Lottery Results article. Let me explain what is my understanding how USCIS handles the H1B Visa 2009 Applications.
Once USCIS receive the applications, unique bar code was attached to the application and that bar code was used for random lottery selection. If the application selected will be then checked if its submitted under regular h1b processing or h1b premium processing.
If the application was submitted under premium processing, then H1B approval receipt will be mailed to the attorney who filed your H1B Visa application. You can contact the attorney to see the results. As per the interim final rules for H1B Visa 2009, H1B Receipt will be sent only to those application selected under lottery process. If your attorney received the H1B filing Receipt, then your H1B Visa for 2009 is approved.
Online Status Check
It’s not possible to search or look up if your application is submitted, before you get Application Receipt Number.
Once you have the receipt number, you can create an alert notification from USCIS Once your H1B Visa is approved, email will be sent to you, alert notification ca be created at USCIS Case Status Online.
One of the other way is check if the check you submitted for USCIS is cleared in your bank. But you will have to ask Attorney if the check they sent is deposited by USCIS. this not the right way, but can indicate that your H1B Visa is selected in random lottery.
Did you get RFE?
I have seen most of them who are writing comments here are waiting to hear about RFE on H1B. I have also posted an article that will help you understand more about H1B RFE Processing Time and when you can expect to hear something back. Good Luck.

Should be go for visa stamping if our employer asks us or esle we should wait till the preition remains valid i.e for three years from FY 2009 to 2012. My current status:
I have receipt number (EACXXXXXXXXXX).I asked for H1 documents to my employer but he is saying to wait till market improves.
My concern:How long my receipt number(petition etc) is valid , like how long i can wait to go for H1B interview(Validity?).Because from April 2009 USA is going to start accepting applications for 2010.

Bank Statements are must and should okk.Definately VO will ask about those statements.So better to take Bank statements.If you are not getting your statements then try to put FAKE(must be good company not in block listed).
Now a days the VO’s are very strict and asking for each and every document ,so it is always better to take every doc beyond us.As a friend i am giving you this suggestion i knew you are always angry on me.

@Venkat: As far I know attorney have to handle the RFE cases. Regarding the fees, its between you and the employer. Some of then don’t ask extra for the attorney.

My case is changed to Request for Additional Evidence Set from Case Received and pending status on 3rd Oct, 2008. Now my employer asked me to pay $750 for lawyer (atorney) fee to process further. He told me, “If we send evidence documents directly to USCIS they may keep pending again, that’s why we should go thru atorney”. Is it true? Plz comment on this.

sure!!! i went to embassy in london. there were lots of people. got in got a number and i was waiting for my number to be called. after maybe 20 minutes i was standing in front of a lady which took all my paper, got my finger prints etc. then wait again. after over an hour i got called to another window where really nice men aked me what im gonna do in usa. i answered. then what is my position now, and if i ve ever been in states. i answeres yes as i just came back in february. then he asked me how long i have been living in britain(as im not british). when he started write something on my ds 156 i knew i got it. he said: im approving your visa today, please go and arrange your passport delivery. i said thank you and i left.
it was soooooooooooooooo easy. i ve been before for j1 visa interview 2 years ago in the same embassy and it took much more longer. this time my interview was maybe 5 minutes or less. i guess they had good day over there as a lot of people got visas when i was there. but each embassy is different and each case is different. i guess i was lucky. good luck hope it will help anyone

Usually, once H1 petition is approved, it normally is valid for 3 yrs except if the employers revokes back. So you should be able to go for the stamping as long as the petition is valid. And the reason why most of the employers are not encouraging for Visa stamping now due to the obvious downtrend currently that is prevailing in US. It is always better to wait for things to calm down rather than eagerly going to get the US consulate, getting a 221(g) (which is very common these days) and then waiting indefinitely for the case to be moved further.

But on enquerying my employer, they told me that as the US market is down, they are going to send me for visa stamping in February 2009.

@NARRY: I have to explore more and find the details for you. I have seen few of my friends who got H1B approved through Infosys, TCS and Patni, went for stamping after 6 months to 1 year. But, I will have to find the reasoning behind that.

My application got “APPROVED” status on June4th but till date I havenot received any documents. Whenever I call up my consultancy, they say that I will get them but havent see anything tilll now. Bit frustrating and worried now. Is it possible that we have such cases where there is a delay in sending the documents.

I am on H4 visa in the states and my H1B is applied in the vermont office. I got the receipt number from my employer and it shows that my case was received on 7th April 2008. Till date it appears “CASE RECEIVED AND PENDING” when I check online. My employer told me recently that they received some minor RFE regarding my eligibility for H1B and they have replied to the USCIS. But the case status still shows “CASE RECEIVED AND PENDING”. Is it possible that the case status does not get updated online even if they send an RFE? If yes then how long will it take for my case status to change? I would appreciate any valuable comments on my case.

I received documents from my employeer like I-797B form, and US company offer letter and job described profile letter and also LAC (Department of Labour).These only i received from my employeer.He is telling me that i will send u the I-129 from when u conformed ur appoint ment .I consulted one Consultancy those people are telling that apart from these documents we should require TAX returns forms ,Project Description and as well as W forms(Unemployeement wage reports) Is this compulsory? But i am very much confusing that will he provide these documents surely? The project desription letter means what should be there in project description plss give detail information about this project description letter.Please let me know the information from you which one is needed in the time of VISA interview3

@vijay: Usually if the companyis small, they will have lots of questions ot make sure, the company is in fact legible. But, its good to carry some documents related to project you will be working, since company size is small. But, it might the case where, they might not even ask for much documents. But, its better to be prepared for the worst case. See if you can get any related documents. Good Luck. Refer to Murthy.com forums and immihelp.com for more details.

My H1b application I-129 ( COS from H4 to H1 ) has still not been approved after being picked in the lottery. I have been waiting for four months.
My H4 is going to expire on October 1st 2008. I don’t know what to do, I have just moved my case to Premium Processing. But incase it doesnt come by September 30th what should I do? I guess I would have to apply for H4 and my H1 would get void with the last action rule

@simran: There is nothing you can do about that. you have to wait till they give it to you. Technically, they are not supposed to get money from employers for H1B sponsorship. But, that the way it’s now and its a business for the consulting firms.
@simran: You cannot transfer your H1B visa to different employer until you have H1B approval notice. You have not other choice other than to wait. You had said about employer asking you to send some documents and interview, what was hat about? Did you have to pay for H1B?

@simran: I’m not sure, if I’m getting it right what you are asking for. I assume your H1B Visa is approved, but employer is not sending you the H1b visa approval documents. I’m not sure what documents you have to send after getting H1B visa approval.

means taht your attorney while filling your H1 visa application skip some documents to file and now USICS has asked for that documents.Ask your employer/attorney that have they replied for RFE because USICS generally give deadline for submiiting reply

As far as I know USCIS will send rejection letter to your attorney. If it is not selected in lucky draw, hence you can ask for rejection letter as a proof that they have applied for your visa.

@DearMg: Its’ my understanding that if Change of Status for H1 is approved, then by default, your status will be H1 from Oct 1 2008. If you leave the country, you will have to get H1B Visa Stamping. You can check forums in Murthy.com to verify the info. Also, I think, if you got H1B approved and don’t get into payroll in 3 months, it will become void.

I am presently on H4 valid upto 2009 and my H1B petition with COS has been approved with effect from oct 1,2008. I need to travel to India on 30th Oct ‘08. But my employer is now saying that as he has no project on hand, i should come back to US on H4 and not go for H1B stamping immediately..
1) Can I come back to US in Nov ‘08 on H4 instead of H1B?
2) If yes how will it effect my H1b status? Will my employer have to file a new COS once he gets a project for me?
3) So what will be my status from 1st Oct 2008 – 3oth Oct 2008? Will i be out of status for one month?

until now, my lawyer have not receive any approval nor rejection letter. my lawyer emailed me that she had spoke to the AILA liason and they told her that thee USCIS is waiting to see how many request for evidence of already filed H1B would get denied. RFE (Request For additional Evidance) this means Whenever the USCIS people cheked your application then that time they verified your all documnets which was presented by your attorny.In that verification your documnets are not satisfied by the USCIS people then they will send you this RFE.So they send a mail to your attorny people for about this RFE.If a person got RFE notice then that peition will take some more time for got approval nearly it will take another one or two months time .According to the rejections on RFE I saw a message from one person that he got rejections when his application in RFE situation but don’t worry somany people are there who got their approvals even they are in RFE .So we will pray to god for approval and keep confidance on you okena don’t worry everything will be fine.So u have to wait one month byee (Edited – Removed Email id – by author)

I have applied for H1B through a consulatnt company in US. He informed me in last week of April that my case has been selected in the lottery and sent me my EAC 13-digit number. Since then I am regularly checking the status of my case with the help of this EAC number but the status that is comming there is “Case received and pending”. What does this mean? In fact we two friends applied on same date through the same consultant. His online status is “Approval mail sent”.
Does my status mean my case is rejected or something?
My cheque is encashed in April end but no receipt yet. Can i Still have hope?

@ Heide : You how how USCIS works, there is nothing we can do nor attorneys can do. Either USCIS has to return the papers back to attorney. If that haven’t happened, then your attorney is the only person to lean towards. I know its tough, but got to wait.

@Aibe, we already agreed to re-apply my case next year. My employer’s lawyer did not advise to use another visa type for me, so I don’t think there’s a perfect alternative for it.

Unless they send you the H1B Approval, you cannot appear for H1B Visa Interview. Best thing is to ask for the documents or ask them how can I come when you haven’t sent me any documents?

My wait is over too, just that it’s negative news. My lawyer finally e-mailed me saying my case was not accepted and that the petition was returned by CIS. Not so good luck this year, but we can always re-apply next time! How about you Heide and Aibe, how are your cases going?

My Notice date is April 24, and i have been waiting for al most 3 months to get approved. My status now is still showing pending now. my notice write down:
This notice does not grant any immigration status or benefit. It is not even evidence that this case is still pending. It only shows that the application or petition was filed on the date shown.
Raghuram: Does this mean my application is on waiting list? How long i have to wait. My opt is expired soon

But the employer has been behaving quite weird oflate.. He isnt replying to emails, and phone calls.. As also, its almost 4 weeks since we received the mail about approval, but havent heard from him since.. Hence am a bit skeptical.. does it usually take so much time?
@MG : You don’t trust your employer? How to you plan to work for that employer?
@Others: There is now way to trace back to your employer or your application as far I know. Hard copy will usually mailed to the attorney who submitted the application within 1 or 2 days after you get approval. But, depending on where you live, it will take time to get to you. It has to come from Attorney to your employer and then employer has to send that to you. If you happen to live outside U.S. it might take longer. Again, it all depends on your employer. There are times when attorney will send the approval notice directly to you.

@Justyna : USCIS will take approximately 2-3 months to approve H1B after you got your Receipt Number. If someone got within 1 month dosen’t mean you will get in same time. I recently moved to new company and have applied for H1B transfer and its been already 2 months and I know I will have to wit for atleast 1 more month before approval come through.

Congratulations for your approval keep it up.Next step is that VISA interview,after approval notice the USCIS people will send documents which are useful for the VISA interview.This means they will send you the work permit i.e I-797 form.Along with these documents you have apply for VISA interview appointment these things will remind you by your consultancy people you need not to worry.So please be cool your consultancy people will get your papers from the USCIS with in a week,but they will send you those papers after sep only it is because that will be valid from october.So you have to goto your nearest consulate for VISA interview in october if all the success in VISA interview you will get the VISA stampping,intially they give you 3years VISA.I think this information is sufficient for you,still if you have any doubts plss feel free to ask me at anytime and mail me too my mail id is “XXXX” Edited i hope u will

I am the regular reader of this topic; I have also applied for h1B. Luckily it got picked in the lottery. After almost 2months of pending status, on 11th July the status got approved.
I am working with x company in India as a SAP Functional consultant and have applied for h1b processing through different employer. I got a mail from my employer (consultant) saying that it will take 5 to 7 business days for them to receive original approval document from USCIS.
Dear admin / Any of the topic participants, kindly let me know what all documents are needed from the employer for h1b visa processing.
I have observed that my employer is posting the job requirements almost every day in DICE job portal.
I have read some where, during h1b interview, consulate will ask for tax papers of the employer. I don’t know whether we can ask the tax return documents from the employer or not. Kindly summarize the exact requirement of list of documents. It will help not just me but also all other members who got their h1b approved.

@ Aibe: You are already in U.S. so you must feel satisfied atleast for that. you have chance to extend OPT for other 17 months and apply for H1B Visa next year. Think about others who applied from their home country, they are not well informed about the process and have no way to contact the attorneys, employers(consultants) will not give proper response. I have heard cases where people paid money to consultant for H1B application and employer didn’t file the h1b application at all.
@admin: I have the same situation as Heide and Mae, my employer tell me that our attorney did not receive neither receipt nor a rejection letter. I am in New York and on my F1 OPT period. Is it any different from people applied outside the U.S.?
im still in the Philippines, my lawyer told me to wait til august because there might be a chance that i might get a visa. but is there any chance that my check might be en cash in the latter part of May or in june?or once they have done the lottery and pick the 65T applicants,they will en cash it right away? its so hard to hear false hopes from the lawyer.
@Heidi : I can certainly understand your frustration, but the hard fact is almost everyone who got selected in the random process got the receipt number or atleast check is en cashed. There was no official announcement from USCIS about completion of H1B process. Last I heard was from AILA conference update, that within July 1st week all the applications will be returned back to Employer/attorney. But since they have to handle so many applications, there could be delay is sending the rejection letter/application. chances that you will get H1B approval now is very less ( less than 1%) and that’s my understanding. Where are you now ( I mean country, if you are in U.S. whats your Visa status?)

When I checked with my lawyer days after June 2nd, they informed me that my case was probably not selected in the lottery but that they’re still waiting for the confirmation; however until now we still have not received any rejection letter. DON’T LOOSE HOPE YET, MY CHECK WAS ENCASHED LAST APRIL 15 AND ONLY LAST TUESDAY (JULY 1) THAT I GOT MY RECEIPT, IT WOULD BE LOGICAL TO SAY THAT IF YOUR CHECK WAS ENCASHED AS LONG AS IT WAS STAMPED BY THE USCIS THEN IT HAS A GOOD CHANCE OF BEING CHOSEN. IT WOULD BE A WASTE OF TIME FOR THE USCIS IF THEY WOULD CASH YOUR CHECK AND YOU WERE NOT CHOSEN AND REIMBURSE YOU WITH THEIR OWN CHECK.

I think you should ask your company if your check was encashed, if it wasn’t (like mine) then you can be almost sure that you were not elected on the lottery.
Also I haven’t received any news neither the rejection nor the elected notice, so I don’t think that your company is the problem.

@ mano, we are on the same boat, my check was also encashed and up to now i haven’t got any news. my lawyer told me that when you are on the wait list, uscis will not send you any receipt. i tried to check at the back of the encashed check but there wasn’t any 13 digits stamped. just wondering what happened to those people from last year who had the same problems as ours? it would be nice if they can shed light on our little problem.

Don’t worry you will get your approval soon it is because USCIS will process the H1-B applications like in order they willl process one by one in order whcih they collect applications from consultants so it will take some time to approval a huge no.of applications they have to check out and give approval notice so please be cool.Here my situation also same like u i am also waiting for my approval notice .Actually i got my receipt no on 14th of June still now it is pending.So don’t worry it will change to approval soon so please be happy i think this is information sufficient for you byee..

Is there any one still waiting for Approval letter like me. My status still shows “PENDING” and i can see lots or receipt is changed to Approval already.

I got my receipt on 6th may and it is still in Pending Status.
My receipt number end with ******32. I checked receipt like ****30 which is approved on 6th June ,, and *****34 also approved.

@ JN: I had received my receipt number on 28 Apr, and just got the status changed to “Approval Notice Sent” on 17 Jun.
If you already had receipt number, you will probably get it in these few days. Check with your lawyer / employer to see if they held it for you.

Today my status got “approved” from pending status.Just waiting for officila hardcopy of approval notice.
First of all I would like thanks to “Raghuram” and all who shared their valuble information about H1B to us.
Few suggestion for others:
1) Guys if you dont have receipt number then immediate contact to your lawyer/consultant whether the check has been encashed or not. If so then your receipt number will be written behind of your check.
2)Guys who dont have receipt number then I would probably say this game is over.Not sure but we can hope for the best.
3)Mine batch is EAC08149…..So uscis is picking up the application according to batch number.So pls check your batch number and add day there.Ex 149(today) for 155 will be after 6 days or 7…beleive it this is true logic.

Whatever information you have provided above is true or not..because I have seen people are getting receipt till now…and they are started approving the cases.
I am also waiting the result of H1 visa….but I just found out this…
USCIS Service Center Operations has provided the following information to AILA liaison regarding processing cases under the FY2009 H-1B cap:
1. Except for cases that were being reviewed as potential duplicate filings, all receipts have been issued for those cases selected in the random lottery. The CSC and VSC completed data entry on all selected cases on May 23, 2008, and mailing of all receipts was completed on may 24, 2008.
2. Cases that were thought to be duplicate filings are being hand reviewed to determine if they are true duplicates. USCIS has received approximately 500 petitions that are believed to be duplicates. However, some of these were submitted as “protective filings” due to courier delivery confirmation problems or where the petition was sent to an incorrect Service Center. Each will be reviewed and determined on a case-by-case basis. If the second submission was accompanied by an explanation of the reason for the second submission, there is a good chance of acceptance.
3. USCIS has determined that the number of petitions selected during the random selection process will be sufficient to meet the cap limit. Therefore, the use of the reserve/cushion will not be necessary this year. USCIS has begun to mail out rejections this week.

I applied from 3 different place but no result. I think this lottery is not fair. Big companies and high paying jobs have more chances to get selected.

Hi, I am also yet to receive any updates from the USCIS.
Many of my colleagues, have received a mail from my employer, saying that, they have NOT reached the H1B Caps for the year.
And my employer says, they are still receiving the receipt number( even after June 2nd, 2008). So there is a chance, for all those who are yet to receive the updates.
Unless we get an official communication from the USCIS, we cannot come into a conclusion. Anxiety is natural, but don’t loose hopes!

@ JM : you could be right. Other than USCIS no one know any other details. There is no official communication from UCSIS about this process. So, we will have to wait and watch.
I believe checks are encashed when you have been selected for a spot, so waitlisted candidates’ checks are not encashed until they receive a spot

Checked with my attorney and I don’t think USCIS has made any distinction between waitlisted and rejected applicants as yet (at least that has not been officially communicated).

My filing checks were not cashed as well but my application hasnn’t been sent back to my lawyer yet. Most likely that I wasnt selected in the lottery. Sux big time..
I am not sure we will get any positive news, unless being waitlisted is positive (which I believe is the worst outcome – it just continues the uncertainty and the frustration). At this point, I would just like to get the response (rejection/waitlisted), so that I can move on with my life.

congrats for getting the receipt number.now your case will be adjudicated by the USCIS.it will take around 8 to 10 weeks to get the approval. the chance of getting approval is 90% it depends on the documents ur attorney filed.

first ask ur attorney whether the cheque is cashed by USCIS or not. if your cheque is cashed then you won the lottery and it will take some time to get your receipt number.

Hi All,
For those who have received their receipt number should have got the I797C Notice of Action. Or the Receipt Number would have shared by your employer after they receiving this Receipt Notice. You could ask our employer for the same if they havent shared it with you. Those who have not received any receipt by now can wait till June 2. If you check is cashed by USCIS then your employer would have received the I797C notice of Action Form or otherwise may be on the way.
If you are a PP case and still not heared about receipt number then I would say the chance are less that it being picked up.
and for other can still wait until June 2nd and still have some hope.
Usually by now most of the lots picked up in lottery should have been intimated. May be it all depend on the service center as well.
For Case Received and Pending the processing of the application and will take some 2 – 3 months for Approval. Usually that the time or sometime for lucky and premium cases quite early. Usually most of the pending cases get approval provided they donot find any discrepency with the candidature or the employer and etc. etc. I donot know what else they check on those application.
This is my understanding based on my experience and feedback from other H1B’s.
@genmilf : I asked to my lawyer for receipt number and receipt number was behind the check. Beside of receipt number, there were to numbers also including the reference number.
@MDN: I have logged on uscis website and my case is “Case recieved and pending”. So wondering about it. Because till now I dont have any official notification either regrards receipt number or I797C.I got receipt number behind of my check. Can you pls elaborate my case ..because it is too long for waiting …im not sure whether I’m in or in wait list.

Hello everyone.. I am trying to answer many questions in the note:
1. Those filed under H-1B CAP in Vermont Service center will start receiving their receipt numbers OR Lottery rejection notices by June first week. So until then, relax.
2. Those H-1B filers who were able to find that their checks have been encashed, your case is selected for processing. So wait for the receipt number.
3. Those of you who have the receipt number, please visit http://www.uscis.gov and enter your receipt number in the bottom right corner where it says “Check case status” and find out if your case status.
Hope this answers all your questions.
hi vijay, i think you have been selected from the lottery and you just have to waite for the approval. was the receipt number stamped at the back of the check? my check was also encashed but when i tried to look at the back of the check, there was no receipt number only a stamped from uscis. where was the receipt number located in your check? was it located together with the official stamp of the uscis or was it written on a separate space? at least you were able to access the uscis website don’t worry about it it is good as approve already you just have to waite

I applied for an H1B visa and my employer sent 4 checks:
- I-129. Application fee
- I-539. Spouse H4 application fee
- Fraud prevention
- Training fee
I haven’t got any receipt but the I-129 and I-536 checks where encashed, could that mean something or I need to wait for either a receipt or the fraud prevention and training fee checks to be encashed?

@Nage: You need to be happy for that fact your H1b is selected in lottery. It will take 3-4 months to get approval. Till then your application will show Pending status. Nothing to worry.
@Damy : I-129 is the H1B petition type and once you get the approval, you will receive I-797
@Honey : Wait for another 2 weeks before you decide about H1B status. but, hard fact is, you might be out of luck this time too. Let us know if you hear anything.

hi to all, just as most of you are waiting, i myself had been waiting in agony cuz my check was encashed last april 15 and up to now i haven’t received any mail from the uscis for the receipt number. I had applied under the premium processing and i am troubled by the fact that it is more than 15 days from the lottery and no result yet. my lawyer told me to wait for the first week of june for the final result cause maybe i was on the wait list. If you are on a wait list does the uscis cashed your check already? would they return the check if you are not selected on the the wait list? as per uscis memo on their site, wait list entrees are either approved or returned with fees. still waiting for my fate

I got my receipt already, I am not very sure about when my check got encashed, But in receipt there is section called “Notice date it which it is mention 6th May”.( I belive this might be the same day check got encashed).
I got a receipt last week on 13th May.
My worry is that it sill in pending status. Waiting for approval.I don’t know how long that gonn take.

@Nage, Vijay: i checked with few others who got their check encashed, but haven’t receipt number yet. You should start getting the check anytime soon. If your check is encashed, then its strong indication that your case is selected in lottery. With so many application to process, it might take them little longer.

I got receipt for my H1B visa filling under non master cap. Notice date state 6th May on the receipt, but still says online status shows “Case received and pending”. It’s 21st MAY. How long does it take generally to get a response? And what are the chances to get Reject? Since it takes so long almost 3 weeks now does it mean they are going to reject? @Harry: You can ask your employer who have filed your H1B, but if they haven’t heard anything from USICS, they will not be able to give you any other update. But, its good to ask to see if they received any receipts.

My company applied for 3 people 2 people got receipt on 8 th May 2008. My attorney mailed me on 14th MAY 2008 that it SEEMED my application has not been selected. But he has not received any notification from USCIS about my case. Then how an attorney can say it seemed not selected. What are the parameters, how long should i stay hopeful that my application can get +ive response since its already 16th MAY 2008. As to my assumption no one has received so far rejection status, as USCIS might send notifications to those whose applications has been selected. So delay means can be -ive.

My petition was filed on April 6th in Masters cap under premium processing. My lawyer still did not receive the receipt number from USCIS. Are there still chances for positive response? Can you give me an idea how long it may take?

I wouldn’t say that. unless you get your money back or hear form Attorney, you have reasons to be positive about your Visa.
Hi…i files on April 1st with premium processing for h1b (non masters cap). i still have not heard anything – given that the 15 day period started on April 14th, does this mean i did not make it through the lottery since 15 days have already passed?
