H1B Visa 2010 – Strict Hiring Rules

Economy is in recession and H1B Visa 2010 season is on its way. Applications have to be submitted for H1B Visa in the month of April 2009. With economy in recession, its hard to find job. More than 500,000 workers lost job just in month of January. So, U.S. government is lending money to banks, but banks that get the bailout money cannot hire H1b Visa workers for next 2 years.
Why Strict Rule for H1B Hiring
So, if you are planning to apply H1B Visa 2010 then its tough decision to make. Already so many are in US without jobs, and if new bill becomes law where companies cannot hiring H1b workers, then you know it will be tough to get job.
Some are predicting economy will get better by end of this year. But, lets assume if that happens, about 3 million people who are in US without jobs will also be competing with ones who applied H1B Visa 2010. There are few economist predicting this situation will last for another 2-3 years. some are predicting number of petitions for H1B visa this year will be far less than last year.
If new rule is passed, then so many banks cannot apply for H1b visa and small companies are not in hiring mode, they will also not file H-1b applications. So, this effect will be reflected to consulting firms who file visa applications for employees who are located outside US. Overall the impact of the new strict H1B hiring rule will reduce the number of H1B visa applications for FY 2010. If you planning to for this year, make sure you select a good consulting firm who has reputed immigration attorney to file your application.

this is just great, add another short-sighted rule on H1B which already has another stupid restriction by having a quota on H1B applications. Those illegal immigrants and fraud political asylees don’t have a quota to enter and stay in USA!!!!By keeping highly educated professionals come to USA to contribute to this country, and let those fraud asylees obtain green cards and then sucking money from US government to subsidize them, where is this country going? Are those senators and law makers are blind or their brian just short circuited?
one more thing, i feel weird about is that when foreigners apply for a travel visa to USA, why the denial reason is that the applicants have “immigrant intent”. I mean isn’t USA built by immigrants.
I THINK THE DECREASE IN NUMBER OF PETITIONS IS NOT ONLY DUE TO THE RECESSION BUT ALSO THE TARP LAW THAT WAS SIGNED. THEN AGAIN—THE TARP WAS STEMMED FROM MR. RECESSION HIMSELF……
BUT HOPEFULLY THE H1B APPLICANTS WOULD BE LUCKIER THAN THOSE OF THE PAST, DUE TO THE FACT THAT THERE IS LESS A CHANCE OF THERE BEING A LOTTERY IN THE EARLIER DAYS.
will this new h1b hiring rules affect physical therapist and nurses profession too?
If you are coming to USA on H1B, resigning in Indian Company have a backup plan always. Like keep a job offer from another indian company and have the joining date after 2 months. If things turn bad you can go back settle in new job. It’s only a suggestion.. All the best for all new H1B aspirants..
If you have a job in India then why do you guys want to come to US and get a job over here. You can wait till the market gets good right…

Can any one tell me whether there is another assessment/ verification process of applicants even after he or she gets at H1B visa number from (may be) the randon lottery? Are there chances for him/ her losing the h1b visa from that process at a later stage after paying all processing fee etc by the company?
For heaven’s sake 3 million software developers and other IT professionals are NOT unemployed in the US as thisblog suggests . Situation is not so bad at all…
But yes if drivers, receptionists, insurance salesmen, bank clerks and waiters are being brought into the US on doctored papers, they will have to fight for jobs with the citizens…
You think statistically. For one who does loose the job and/or cannot apply for new one and has to be departed because of H1 restrictions your statistics does not help. Besides I never heard about drivers/clerks coming to US on H1 visa.
If US citizen cannot compete with foreign professional he should do everything
to survive the race without breaking legs for his competitor. And even indian
programmers are ready to work for less money (I heard this only theoretically, because in my field, for instance, there is no salary discrimination and I don’t understand how it is working practically) so this is an economics. If a employer
does not want to pay more money and is not allowed to pay less he will outsource
the job and out job market will suffer anyway.
@Milind – I’m not sure if you are misread. We said 3 million jobs lost in US not IT developers. Here’s link for you http://www.vault.com/companies/layoffs.jsp to tracker all the companies laying off workers. Situation is not bad at all if you live close to people that are not losing jobs. But if you happen to live close to where whole plant is closing and entire town is depended on that plant.
I dont think, there will be any decrease in no. of petitions this year.

As far as i know, many consultants have not filed for H1B visas this year. I tried to get in touch with many consultants thru my friends & cousins who are living in USA for ages, but hardly i could find one.Fortunately i found one out of many who is ready to file a H1B for me..So, statistically, i understand that the number of applications for H1B for the 2010 fiscal year are comaparitively less but not too less than last year.I also heard from my friends that there will be no lottery this time around since only a fair number of applications are recieved by the USCIS, where the lottery system is required.
Anyway, ALL THE BEST TO EVERY ONE WHOEVER IS IN THIS CAMPAIGN.

I agree with you. The number of applications will be in the range of 150-200K atleast on first day. All students and people who failed in lottery last time will apply.
Let me explain. 163 K people applied. 85K got accepted. That means 78K will apply. Last year around 35K applied for masters quota. Number of students applying will be growing by 20% every year. Therefore from students around 42K will be applying. Indian consulting companies will file around 50K and US consulting will file around 30K (far less than last time). therefore adding it will be 200K. Some people who try last year may not be trying again therefore i say it will be between 175K to 200K.
Our senators seem to have quite short view horizon restricting H1B visas. The smartest and most active immigrants in a few years after coming opne their own business and finally generate new jobs.
US is built by immigrants all US success is from immigration, especially high-end professionals. If one cannot compete with an immigrant on a job market he does not deserve this job and has to learn hard in order to compete. H1B holders pays all taxes and do not have social rights like unemployment bebefits etc. Literally they support all our social base of pensions for free.
We are killing ourselves restricting professionals work in US.
This bill create a problem for H1B Extension ??? I have to apply for extension in Sep-09 after my 3 years H1B visa. I know that H1B is valid for 6 years, so this bill create a problem for people like me. one more thing, our company will not get any money from stimulus package.

Does this also apply for employees working in firms which are not in TARP. Companies like start up which are still not public and need software engineers will hire new H1B Software Graduates?
How much this new bill if passed is going to affect Software Engineers required to work in firms which are not TARP firms?
This is what happened recently for H1B candidate at port of entry..
Immigration office asked.. the contact number of the employer..
he called the HR.. and checked whether how long back they tried to hire citizen/GC holder for the same position. And HR said.. 3 months before.. Then he asked.. do you think nobody in US will fit for this position.. then HR said.. if we try again.. we may get one..
THAT’S… the guy deported back to india. So, be careful.. till you enter inside the country.
