News flash from USCIS on H1B Visa 2013 Cap Count.
As expected, USCIS have received sufficient number of H1B visa application for FY 2013.
H1B Visa Cap 2013 Reached
Following was posted on USCIS H1B Page.
- On June 11, 2012, USCIS received a sufficient number of petitions to reach the statutory cap for FY 2013.
- On June 7, 2012, USCIS also received more than 20,000 H-1B petitions on behalf of persons exempt from the cap under the advanced degree exemption.
- USCIS will reject petitions subject to the cap for H-1B specialty occupation workers seeking an employment start date in FY 2013 that are received after June 11, 2012.
- USCIS continues to accept petitions exempted from the cap and DOD cooperative research worker H-1B petitions and Chile/Singapore H-1B1 petitions requesting an employment start date in FY 2013.

As I know the cap for H1B is full for Y 2013. Is it probable that cap reopens in october 2012 ,if some of the visas get rejected ( I don’t wish so , but just checking as i am in the que .

Hi, My employer filed my h1 in master cap and sent application on june 6th..USCIS said master cap closed on june 7th but i think my application reached on june 8th …
I have following question plz help me ASAP….
1. if master quota filled so i automatically transferred to the general quota which closed on june 11th?
or
2. they are telling that they still accept application for exempt application so i m that?
or
3. they wont consider my application?

What are the exact meaning of petitions exempted from the cap? Does that mean it will still receive the petitions for master degree holder and do the lottery thing?
exempt from cap and DOD menas not for profit organization- visa does not fall under cap quota of 65000+20000

No unfortunately the cap has been reached for this year. The only way you can get a H1B without waiting October 2013 is to work for a non-profit organization or university.
