I saw an interesting comment about H1B Visa application approved so far and that was the last update from USCIS. Comment was to the article H1B Visas Approved
* Total H1B Petition Approved – 59,100 petitions under the regular cap
* Pending approval – 9500 ”So the total number is 59100 + 9500 = 68600, which is grater than 65000. How does it possible? Can anyone pls give me the link that USCIS published the notice.?
Total H1B Visa numbers available is 65,000. but, USCIS selected more applications in lottery, so if some of the applications were rejected due to false documents or any other reasons, they don’t need to conduct lottery again. When 65,000 applications are approved, rest of the application even though selected in lottery will be denied H1B approval.
That’s my understanding and opinion. You can consult with an immigration attorney if you want any clarifications or with the attorney who must have filed your H1B Visa petitions. There are about 10,000 H1B Visa applicants still waiting to know visa approval status. From the comments I see, I think most of them haven’t even meet the employer in person or don’t have direct contact with the attorney who submitted the applications. Some of them dint even have the receipt number.

Hi, a representative in the US filed my H1B application last April 2008, and until now I haven’t receive any notice receipt or any proof at all that will tell me if my application was randomly chosen or not. Is it possible that my application was still with the USCIS and they have wait-listed it? My representative said that she had filed again my application this April 2009. Is that possible too?
i filled my h1b with consulating company in april 2008.i got approval also but the mantioned date of birth in this was rong so .so i have send back it for correction .six month has gone but i could not received it .i called my employer.he mailed me receipt number . i have cheked on line my pendig status and finally i know that my approval has been send before 15 days .but my employer said i have not receive it .so how can i know my employer is said true?

I filed my H1 B with a consulting company before April 1st 2008 and they told me they filed it. The company told me I was selected but they haven’t received my approval letter. I told them to proof to me by showing me the EAC receipt but they wouldn’t. My question is ” Is it possible to still have an application pending as at today date Dec. 8th 2008? Or the company just played me………

My application was received by USCIS on 9th May’08.
Since then , my status is being reflected as
‘ Case received and pending’. I have not heard from my employer
and he is not responding to my calls.
I am very worried and would really appreciate if you can let me
know more on this.

But I got at USCIS site this,
“USCIS has “wait-listed” some H-1B petitions, meaning they may possibly replace petitions chosen to receive an FY-2009 cap number, but that subsequently are denied, withdrawn, or otherwise found ineligible. USCIS will retain these petitions until a decision is made whether they will replace a previously selected petition.”
