H1B Visa approved, but no documents

My application got H1B Visa “APPROVED” status on June4th but till date I have not received any documents. Whenever I call up my consultancy, they say that I will get them but haven’t see anything till now. Bit frustrating and worried now. Is it possible that we have such cases where there is a delay in sending the documents.

I797 Approval Notice

After H1B Visa petitions are approved, USCIS will send I797A or I797b or I797C [ difference between I797A, I797B and I797C ] approval notice to attorney who have filed your H1B Visa application. H1B Approval notice will be usually sent within 1 week of H1B Visa petition approval.

In your case within June 12th your employer’s attorney should have received your documents and attorney will forward the H1B Visa approval notice, along with labor applications.

H1B Visa Stamping documents

To get H1B Visa stamped from U.S. Consulate, you will need the original H1b Visa Approval notice and other related documents. So, I think, all the documents should be with your employer. There is nothing you can do, if the employer doesn’t send the documents to you.

You can go for H1B Visa stamping only after you get the documents from the employer and unfortunately, there is no way to trace the documents.

    hello, iam on opt. my opt ends on oct 4th 08. my company applied for my H1. in uscis site my status is showing as ‘case received and pending’. today date is 10th sep 08.iam worried. how long it will take for my H1 to get approved? i have more 20 days for completeion of my opt. please send you views.

    My agent has been saying me that my H1B petition has already approved and they will send documents. But till date, i neither got Receipt number not documents. do you have any idea that what might the case. are my agent making me fool?

    hi author, my H1 got picked in lottery. then what is the need to apply for opt extension?? extension is for those whose H1 did not get picked. hope u got my answer. but i did not get what i wanted.

    hi MG, u can check ur H1 status in uscis website. all u need to do is type ur receipt number and get ur status.if it says ur H1 is approved, then u dont have to worry. u dont have to depend on ur employer to know whether its approved or not.

    @tibbu: worst case possibility is when you don’t hear about h1b visa till your OPT expiry date. After OPT is expired, you can continue to stay in U.S for grace period of 60 days, if you haven’t used it before. But, you cannot work in that period. I haven’t read any rule saying, you cannot apply for extension when your H1B is picked in lottery ( I could be wrong) but I haven’t read any articles about that yet.

    If you apply for OPT extension, you can continue to work till you hear about h1b right? I would suggest to post questions in Murthy.com forums or why not conusult with same attorney who submitted your H1b application?

    If the additional documents submitted by employer is sufficient, H1B will be approved.

    Hi there,
    I got the petition approval letter, but my sur name in the letter has an extra character. Is this a problem? What do i have to do to correct my name in this? I have the receipt number and checked in the gov site to check for details, but it does not give the details regarding the name of the person for whom the petition was filed. Is there any site where i can check my details for the petition approved? I want to verify whether the official spelling is the same as that in the petition approval letter.

    i have still not got approval yet even after submitting RFE as on 07/15/08 …@raghu pl tell does it take even more then 60 days to clear RFE …can i call USCIS and ask my status …why it is taking so long..though i dont see any problem in my case ..i am chartered accountant and working with small cpa firm…one of my collegue has same credential and she got approved then y i ma struck…my husband has also applied and he also got RFE …we both are in lot of stress since my husband is on l1 and his company want to send him back…pl reply…we are running short of time…pl annnbody help …i m daily dying wid this wait,…pl help

    My case has been selected in the H1B lottery, I have been asked for further evidences by my employer, So far I did not hear anything regarding approval?

    Is Oct-2008 is the last month or approval is given after also?

    @hema: As far I know, there is not time frame USCIS have specified any time limit on when they can respond after you submit RFE. There is nothing we can do about that. There were cases where, H1B was rejected without sending RFE. It really doesn’t matter if your collegue’s profile is same as yours, if USCIS have some doubts, they will clarify it. Good luck. I don’t think they will respond if you call.

    Hi all.. i hve my receipt number and when i checked my status online on 9th sept. it says “Response to request for evidence received, and case processing has resumed”
    its been 2 weeks now and i have not received any response… i am gettin really worried now. Can anyone please help me…..are there any chances of my case being approved, how lng will it take coz today is already 23rd

    My H1b Visa status online still shows CASE Receive and pending.

    Pls help me know as to why this is getting delayed in selection. My Consultant says we have to wait till 30th October, is that correct?

    Hi Guys,

    I got my H1 B selected in the lottery long back. Till now I have not received my petition. Among a list 650 petitions expected by my employer, only 4 are still as case received and pending. Please let me know whether this is because they have lack of information to process mine ? Why is the delay happening only to mine. ?
    Is there any way we can get to know the approximate date when we will receive the acknowledgement.

Now she got RFE..Info requested was some company info and my latest paystubs..we got RFE on date 25th Jul 2008. we asked employer, he forwarded the courier details sent to VSC. its sent on 19th Aug…but her status is still same as previous one.     I think no one has answer of ” How long will it take to get the status change”. It’s just luck. I don’t know in which order USCIS is picking up applications and approving. It can be the order in which they got selected in lottery. My employer said ” mine was picked up in last” , tht’s why you haven’t heard any thing from USCIS yet. I don’t believe this ..How last was it…….

    It’s just our luck I wud say… Pray to God and keep hope :)..

    hi guys

    i got a query on my H1 2.5 months back. this is what it says on my status online, “On July 30, 2008, we received your response to our request for evidence…… You should expect to receive a written decision or written update within 60 days of the date we received your response..”
    60 days have already passed and it is showing the current status as, “Current Status: Response to request for evidence received, and case processing has resumed.”

    My employer is not e-verified so i can’t even apply for extension of OPT.

    totally confused!..is thr any way we can get the approval expedited now?

    any other suggestions?

    Hi All,

    Some of the request here are like asking doctor for Life Saving drug. Please don’t be so desperate, my case also pending as of now.
    Search for alternatives to stay here if any one feels they will die the moment they land in India.
    My OPT expires on Jan 15.., if I don’t get my H-1 I am packing my luggage to India.

    Anybody got any upadates? My case is still saying Request for Addition Evidence Sent. We replied RFE and they recived through FEDEX…but stil nothign changed. I get RFE on 25th July 2008. The LUD was changed 09/01/2008. But still no update . I am so worried. Mine case is H4 to H1. Please anybody can help me out.

    hi nagesh, u dont have to leave USA as long as ur case is pending.even if your OPT expires and H1 is pending u can stay here. my OPT ended on oct 4th 08. my H1 is still showing case pending. urs is in jan, mine is ended.then what shud i say.

    Hello everyone,

    My husband got the H1B visa in the lottery.
    But the case status is pending.One of his friends who got the H1b in the lottery at a later date than my husband ,already got the H1 approved.

    Our lawyer had sent an enquiry to Uscis abt. the delay.The reply says that the documents are fine ,the delay is due to some “security clearance”.
    So there is some hope that all of you should get ur H1.
    The only problem is that they haven’t mentioned any timeline.
    We are keeping our fingers crossed.

    Based on some tracking that I was doing from the past couple of weeks, I believe USCIS is processing the applications on when the RFE is received by then. So if the RFE itself is received byt you on 25th July, I think it might take atleast couple of weeks from now to get some status. The current processing dates are still in the end of June or early July cases. So best of luck for approval waiting.

    My case is changed the status from “case receive and pending” to ” Request for additionl evidence sent” on 3rd october. After 30+ days my consultant asked me to pay $750 towards fee for atorney to send required documents to USCIS. Is it true ? I have a doubt about this issue… plz let me know anybody knows… appreciate reply… thanks in advance.

    Hi Guys,

    In my company there were about 300 RFE’s same day about 40 RFE’s (One of them was mine) were sent and received by USCIS next day.

    Most of these cases are now rejected, my roomate whose RFE was sent on same day as of mine got approved (other roomate got rejected) and mine is still pending.

    Hema, the date RFE reveived has no role to play when they aappro or reject any case.

    In my whole company some 10 are pending, 95% (350)got rejected very few were approved.

    Your consultant will have some 30 or 60 days to respond to your RFE, it may be true. You know all these people are Blodd Suckers.

    @malahar: My friend’s wife has your background, she came in H4 visa and got her H1 in lottery last year. she’s searching for job in fiance accountant, kinda jobs since last 5 months. I dont think with your back ground there will be direct job available to sponsor CA

    Hello All,

    My case number is EAC081435**** and my case still shows as “case received and pending” and the LUD as Sep 25th In the mean while i applied my OPT/STEM Extension too and i received the receipt number on OCT 27th and its the same status as my H1. My Company is sending me to India for training offshore guys in delhi all my flights are confirmed. My OPT expires on Jan 2nd and my trip to india is on DEC 10th 2008 - Jan 20th 2009. I dnt have a chance to say no to this trip so can some one explain that if i leave US on DEC 10th can i reenter in to United states if still my status says “case received and pending” Do i need to take any steps before i leave US.

    Please suggest…. I am just looking for a miracle and ALL THE BEST WHO GOT H1 approvals already.
