Hello everyone, looks like few have received the H1B visa receipt number and USCIS Case status Online shows the status of Case Received and Pending. That’s very good news. But. I don’t understand why everyone is still worried after receiving the Receipt Number.

If you have received the Receipt number or if your check is encashed, you are in good positions to say, your H1B Visa is approved. USCIS provides various options once you have received the H1B Visa receipt number. They received my petition on May 7, 2009 and it still pending. My coworker’s petition was received a week earlier and he has gotten his approval more than a month ago. My process is in CA. I sent an email to my attorney last week and here is the answer:

“Yes, your case is still pending with the regular processing unit. The USCIS just issued its processing report, and you are still within the “normal processing” window. We’ll continue to watch the progress and begin the formal inquiry process if there is a delay beyond another 30 days.”

Is it true? Should I take any action at this point?

my H1 which was applied in april 2008 was denied. we had applied one more H1 in april 2009. this is in pending.

dont know what was wrong. but life sucks in US. if this too gets rejected, then i dont know what to do

my H1 status is still showing pending , i dont know why uscis is doing like this.they should atleast take any action. why to delay by testing our patience.i dont understand whats hapenning here.

it took 7 weeks for my status to change from “Pending” to “Approved”
so please be patient.

also, i have heard that processing from vermont (which is mine) is faster than from california.

so if your processing center is California, you might have to wait a little longer

I got my receipt no at may 2008, my case status is now “request for additional evidence sent”. is there really any rules in USA. i think applying for h1b was a great mistake i have ever made.

there are very specific rules and they are designed to prevent fraud and protect the workers. did u send in your additional evidence that was requested? if not then the denial only makes sense. maybe the real mistake is your approach to the situation.

Not finding your case available Online?

The United States Citizenship and Immigration Service (USCIS) National Benefits Center (NBC) Liaison Committee has identified that there is a problem with the interface tool for the “Case Status Online.” Not only has this problem caused much delay in the recording of new receipt numbers in the system, it has hampered the updating of status information for those cases already in the online system. The Liaison Committee stated that the issue was not limited to NBC filings, and that the problem has been recurring. The NBC Liaison Committee did not provide a time estimate of when they expected the interface to be fixed.

Hey MBB. My case is also pending on VSC and was recieved on 22 April 2008, my employer said they have approched US senotor’s office as there is no communication with VSC, I dont know how true is that. My friend had same case with VSC but from different employer she got rejected two days back she dont know why…If anybodoy gets approved please let us know!

@AS: USCIS must have sent the H1B approval notice first time and if that’s was lost your Employer should have requested for another H1B approval notice.

I am also having the same problem. I have submitted the RFE documents, that they wanted. Status changed to “Documents received, and processing will begin”. Two months over now, no change in status. This is bad on USCIS part, they should not make us wait so long, without any information.
As someone said, it is not worth going to US at this point.

Alright something strange is going on here…
I am in the same boat as most you people – case status received and pending, receipt date April 23. After months of wait and anxiety, I decided to take the premium processing route and file for it in 1st week of January. Now the issue is – it’s been over 30 calendar days that Vermont premium processing center received my application but I’ve not been allocated a receipt date as yet. So obviously they are not entitled to follow the 15 day correspondence rule with my case. Is there no law under which they are entitled to issue a receipt date to a case given that they received the application a month ago.

I know my case as advised is under security clearance, but still they are entitled to get back to me in written per the premium processing request that the case has been subjected to review and will advise as and when the review from the concerned institutions is taken care of. Please advise if any one of you can shed some light on this issue and possible correction.

Jane…absolutely not!
I still have a strong feeling that I’ll get the approval, nevertheless I am going to dump it after I get it. I have never waited that long for a thing!!!

I am happy, I have recently switched to a better opportunity where I am rite now, plus I wouldnt goto USA due to the current crisis and its impact on US job market.

hey Guys..
Just in case, has anyone paid any money to the employer while filling H1? If so, is your employer ready to refund it to you? Now that our H1 is in pending status and it is almost 2009 and we all should be filling fresh H1 applications I feel. What do you think?

Security Check is mostly associated with Tax Frauds, any other monetary and documentation fraud (like fake certificates, fake H-1B applications) most of the H-1s are on hold after Report of H-1 Fraud Surfaced.

I think we are all done….!

Hello guys,

My case is pending too. My consultant have told me to wait and have assured me that I will be getting my H1B as without any case having some terrible issues only can be rejected. I don’t know ow much truth lies in that but let’s wait and watch. My petition was received at Vermont centre on may 13th and after that there is no change in status. Did any one of you got the chance to speak to USICS?

As the 2 months processing time frame already over on 31st Oct, so does anyone have any idea as to what will happen next.

I read this below artical in one of the Newsletter-hope this will be of some help to any one of you, though I am not sure. As we have to wait till Christmas or may be till Dec end.

“”We have received a number of inquiries about H-1B applications which are still pending. For those with such pending applications at the Vermont Service Center, our information, which is as of October 20th, is that there were 4,345 petitions that were part of this fiscal year’s cap and which were not completely adjudicated. Of these, 1646 awaited a first look and 1,533 were pending security clearance.

For comparison, as of mid-September, the numbers were 6,344 petitions pending, of which 2,245 untouched and 2,079 were under security review. According to these numbers, it seems that the Vermont Service Center has adjudicated approximately 2,000 petitions in a month. This means that if the current rate of adjudication remains stable, there will be some H-1Bs pending until Christmas.”"

Nitasha,

Same rules apply for both Quota. This delay is because of wide spread fruad plauging Indian consulting companies.

We are not in a position to do anything. Many of my friends who got full time jobs…got H1′s approved with no hastles.

I don’t think upgrading to Premium Processing will help any way …!

Also my case is changed to “Request for Premium Processing”. I applied for Premium Processing but I dont think its going to be any use, because after paying extra $1000 status doesnt change to RFE or Approval notice sent. USICS is delaying all pending cases but not sure why???

Consultant says they are slowly changing all pending cases to RFE …n then God knows what will happen.

Does that mean that the same case is applicable for General Quota also? Is there a possibility that if deadline for general Quota is met then they reject other pending cases? If so then why USICS selected us in lottery?

Hello guys..
I m in the same “Case recieved & pending” slot. However, I got a chance to speak with the USCIS folks but could extract any vital info. They insist on talking to the employer and not to me. What I gather from my consultancy is that there is some “Security check” happening at USCIS.Forget about fresh H1 cases, even H1 transfer cases are stuck up there.. So I hope the cases will get approved, it is just matter of some time. I didnt hear about the 30 Oct deadline though!!

I just talk about murthyforum.com, a website which i found from probably raghu’s blog, where people register for their h1b case.

in uscis site i found this statement.

“If you have a question about case status information provided via this site, or if you have not received a decision from USCIS within the current processing time listed, please contact the USCIS Customer Service at (800) 375 – 5283 or 1-800-767-1833 (TTY).”

you can try this number, i have no idea how much information they will provide for a pending case.

as our processing time is not end , so try after 31st october. hope we all get good news before that.

USCIS can reject your application without any RFE. Use some commen sense folks..! they are not distributing ration cards or driving lisences ! they can give any reson and reject a peding case.

at vermont service center processing time will end by 2 months. this notice is posted at 31st August, so the ending date will be 31st October.

Moreover is there any reason for rejection without any RFE. so worst case may be RFE, after that may be a case rejected. i believe, a pending case never be rejected without any RFE.

case received and pending means the case document is not picked for processing yet. It does not mean possible rejection. it is far from rejection.

we already delayed, so it’s worthless to waste another $1000 for premium service.

In murthyforum.com i found a case in previous year which approved at november, so the last(31st october) date may be not last.

wait upto 31st october, if we don’t find any result then we have to wait for new news from service center.

Can you explain what you meant by we will get to know by 30th october. Even my case is pending at vermont processing centre. I did check randomly all the cases next to my sequence number and could found that only mine was not processed. Does this mean a possible rejection ?

Is there any purpose in coverting this into premium now ?

My receipt date is May 6th and i applied for H-1 extension at California Center and my case is still showing me received and pending.
I just want to know if anybody is experiencing the same delay,,,,,
USCIS is currently processing June 19th.

hi raghu, uscis got my H1 on april 22nd. till now my status is shoing as “case received and pending”. they didnot have query on my case till now. my OPT ended on oct 3rd 2008. how long they will take to approve my H1?? what if they reject?? what is your advice to me??

hello dames, are you sure uscis will clear all pendings by mid week of oct?? bcoz my opt has finished. i have only 50 grace days remaining . might be your consultant just told to console you. because no consultant has answer for how many more days it takes. my consultant called uscis and they said it will take time.they didnot mention how many days??

Hi Raghu

i am in advanced degree H1 quota..i think the cap is 21000…it is mentioned on this site that according to last update 19500 have been approved..and 2100 are pending. Now, 21000 – 19500 = 1500 and 2100 – 1500 =600, this leaves 600. So does this mean that, in all, 600 people who have been selected in lottery in advanced degree quota will be rejected.

Please correct me if i m wrong!

hello chopper, what is end date of your OPT?? iam having same kinda trouble. my opt ended on this october. and since april my H1 status shows as case pending.they didnot have query also. my university people says, after 60 days of grace period i have to leave country and should come back after approval.iam really worried.
any sugestions?????

Hi Guys,

My case was also received on 12th of May and status is still received and pending.

One thing i noticed, if I check next or previous EAC number (I assume EAC numbers are in sequence), they are showing cases have been “approved”.

Just curious why my case is not yet processed even though other EACs in same sequence have been processed? :S

any idea what how do they sequence EAC numbers? are applications from one company sequenced or what does it mean?

my OPT ends in december and my h1 is not cleared till now. same as all the ppl here” PENDING!!!!!!!!”
i was wondering that can i file for the extension of OPT in nov or dec., before last date of OPT.
or do we need to file it 3 months before OPT ends(which for me is already over)?

We should not worry as most of the pending cases will be cleared by mid of october. I am not sure but this was the information given by my consultant.

I think, the only thing we can do is to wait and have patience.
With this forum, we should be kinda relaxed by knowing that there are other cases too with the pending status.

Even my case status also shows up the same message. I spoke to my consultant and he said that, USCIS doesn’t have enough man power to clear all the cases by September end so they would be taking another 30days time to clear the pending cases. Not sure whats going on this.

Anybody please comment back on this ?

My petition was filed on 8th May and the service centre is Vermont.

Please let me know what does “Duplicate Notice Sent” Status means. Its been written under this status as your case is still pending and we will send you an update via email when your case is processed.

One of my friend got this as her status. Please help us know what does that actually mean.

My Case is still pending and we have observed one trend ..Maximum of the applicants whose receipt date is May 5th has their case as received and pending. Do you have any comments on this ?

Repeating my questions. anyone volunteers…..

1. What are the questions US consulate ask during H1B stamping?

2. What are the documents required while appearing for H1B interview?

3. Do they give confirmation immediately or again have to again wait for some time?

4. What are the chances of rejection during H1B interview? or it is just a formality in order to access candidate personally?

Dear Nitasha

I beleive that all employers/agents have their own policies. You should not worry if your agent is trust worthy. Further to above question, my friend had talked on toll free number about his case and verified his details but after very strong request,, you can contact and do the same if you dont trust your agent.

On request, your agent can also send you a copy of I-797C notice of action (one page docuement, includes name, receipt number etc.), which was sent to your employer/agent by uscis when your name was selected in lottery.

Send me mail on [email removed - Author] for further discussion if any.

Who is your employer? Did your agent allow you to talk to attorney? My agent has just emailed me my EAC number and said check the status online and we will get back if we hear something from USICS.

When I check my status its Case received and pending. Is my agent fooling me?
We requested him a scan copy for my notice and receipt number.. he just sent me my EAC number via email. Should I believe him? … I have proper EAC number but it doesnt indicate that this case belongs to me only.

Raghu can you please reply on this situation, I am worried..

Dear Nitasha urpit,

RFE – request for further evidances. USCIS sends request to agent/employer for further documents.
Online status will be changed to “RFE sent”. Once required documents will be submitted by your employer/agent then again status will be updated to “RFE received and case has resumed”. Once they are through with your documents status will be changed to “Approval notice sent”.

Mine case is also pending with vermont center and receipt date is 14th, May 2008.

My H1b Visa status online still shows CASE Receive and pending.

Pls help me know as to why this is getting delayed in selection. My Consultant says we have to wait till 30th October, is that correct?

Still my case is pending and waiting for approval.

But I think that my friend arjun has raised some good topic to discuss it here.

Please answer of my below questions. Any one voluntarily share if they are aware,

1. What are the questions US consulate ask during H1B stamping?

2. What are the documents required while appearing for H1B interview?

3. Do they give confirmation immediately or again have to again wait for some time?

4. What are the chances of rejection during H1B interview? or it is just a formality in order to access candidate personally?

Add more relavent details if any.

Here i am explaining you my doubts please give me clarifications.

Actually I got selected in Random and my peition approved on July 6th My employeer sent me the documents Like I-797B approval notice,LCA,Company Offer Letter,Job profile Letter and requesting letter to Embacy that give VISA to me.He sent these papers upto now.And he will send remaining documents like I-129 form ,Project Description Letter,Company photos with in a week.I asked him that please send me your company tax returns and Wage Reports but my company people are telling that we can’t provide those tax returns and wage reports right now it is because thoses are the company confidential matters.They are telling that in the VISA interview they won’t ask you this documents suppose if they ask about these then we will send those documents in seiled cover untill now we can’t provide these documents.They are telling me like this Here i am asking you that without Tax-returns and Wage Reports should i goto VISA interview?I am going to Chennai consulate on 16th october and as well as i asked them about education evalution letter but they told me that we didn’t do your education evalution and at the time of your H1-B we didn’t do that one it is not compulsoy.Please tell me that suppose if i goto VISA interview without Tax Returns,Wage reports and Education evalution what will happen?is there any problem with these please tell me my doubts and give me clear clarification and as well as your suggestions I will wait for your message

It’s my understanding that toll free number is automated service, you will get whats shown in online status in automated voice. I don’t think you can get to talk to real person. If someone tried and spoke to real person, let us know!

It’s been over 60 days since they received the RFE documents for my case, and I still haven’t heard from them. I’ve enrolled myself in school now, but I was really hoping to get it by mid-Sept, so I wouldnt have to pay the tuition for this semester. It’s a lot of money for just waiting around and hoping to hear any good news. Is there another way to stay here legally other than to keep taking silly courses and pay high tuition?

i got selected in the lottery and still my status is “Case Received and Pending”.
i applied for the H1B through a consulting company. they took their money well ahead from me. do you know the reason for no status change (from the pending status) for such a loong time ? how can i find out what is going on?

@dames: If the documents submitted by your employer is not enough, USCIS will send RFE. If they are not satisfied with that, they can reject the H1b applications. I will be posting an article later today about H1b rejections.

@ravi: If you have receipt number..then your your h1b visa is selected in lottery. There is nothing more you can do now till you get approval notice.

I got an RFE(Query) to submit my spouse’s paystubs as I came to the us of a on h4. I checked online to see when this RFE was issued and I found that being June 25th 2008. I have the paystubs but my employer is delaying in sending those documents by post to the USCIS. Is there a deadline for submitting this to USCIS?

HI ,

I have got my EAC number but my status is still as Case recieved and pending. It is too late to recieve an approval now? Is there any deadline by when the USCIS will announce the approvals.
Last year I had got through the lottery , but got an RFE and eventually got a rejection. Last year I knew in May that I had got an RFE notification.

You will have to come back to India (or the place where you applied for your H1) for your H1 visa apporval man, otherwise your H1 will get rejected.

RFE case:
I too received Receipt Number three weeks and now my employer says they received RFE( Request for Evidence) from USCIS. They asked for an evaluation of education and work experience in areas related to the specialty occupation for which my employer have filed petition for.
I am not sure is it normal and how much time the employer takes on average to furnish the information to the USCIS.
How much timeframe USCIS provides the employer to provide the necessary RFE.

Do anybody have any relevant information about the same.

I got receipt # on 4th june and status is “case received and pending”..Meanwhile i applied for L1 with same employer as some urgent requirement within next month end.i wilb getting my L1 by 1st week of july.if i fly next month, i want to go for change of status in oct to H1.If any1 can help me regarding the procedure,wilb great appreciated.

I feel the same way as you do. It sucks foir me bc my opt expires in 1 week, and I still have no word on h1b. My attorney hasn’t told me anything, and that’s jsut not fair to international students in USA. They just treat us pretty badly.
