H1B Visa FY 2010 – Quota Numbers

There is huge discussion going on in the article H1B Cap 2010 – Not Hit. But there is a quick update from USCIS on number of H1B Applications for FY 2010  received.

USCIS announced on April 08, 2009 that it has received approximately half of the petitions needed to reach the 65,000 regular cap. However, it has received almost enough petitions for the master’s cap. Once the master’s cap is reached, those filing petitions with U.S. master’s degrees or higher can use the regular cap. The 15-day clock for Premium Processing cases began on 04-07-2009.

Hello Sir,

I am a Green Card holder and I am planning H1 for my wife who is in India,as her GC dated in chennai has been stuck I am applying for her H1 now in November ,could you please tell me the rough estimation as to when her H1 will bw filed.

Also can you give me suggestions as to how to go on with the process.

Hello everyone,

I have a master’s degree in Computer Science from a US university and have been on OPT almost a year. I received a letter from my company lawyer saying that uscis has approved my application for further processing.But the I 797 C form does not say anything if my H1B application has been accepted or rejected.The receipt also says the same thing when i checked the case status on the uscis web page.I am confused as to how to interpret the attorney’s sentence.

Also, I am not aware of how to determine if my company opted for premium processing or not.

Could anyone be so kind to throw some light on this?

On which criteria they can reject Visa in consulate?

You can submit your application as long as the quota hasn’t been reached. If you want to get a reply within 15 days, pay an extra $1,000 for Premium processing. If you can manage to wait a bit longer, then just go through regular processing.
Quite honestly, your concern should really be to submit your application before the quota has been reached. Otherwise, any course of application (whether premium or regular) will be useless. Once the cap/quota has been reached, your application will simply be rejected.

Hello everyone,

I am vastly happy today!!! Now we have succeeded in the first step. I start to think about the next step. What is the earliest date we can schedule our h1b visa interviews?

I am a Chinese citizen and have been teaching in a New Zealand university for almost two years now. I do not have New Zealand permanent residence. Where shall I go for my visa interview — China or New Zealand?

Another question is my residence for tax purpose. If I have my visa stamped in New Zealand, will I be able to benefit from the tax treaty between China and the U.S.? I heard that the residence for tax purpose is the country you reside before you enter the U.S. if it is different from your home country.

Hi,

Is there anyway to know whether my consultant has applied for my H1. As per his comments he said it has been filed on 3rd April. Just want to check does USCIS give any application number which can be tracked online (I know about the receipt number i.e LIN… after the lottery process.) For this year if there is no lottery then i should get the receipt number. Lets say for worst case my consultant says he has not got the receipt number, so is there any other way to track from USCIS to know whether my case has been filed in USCIS or not. Request your help.

U should get a receipt number. Acceptance or rejection of visa is the second step. Your employer should get some receipt number.

Thx for regular update. I am also amongst one of H1B aspiriant. It’s good news that there will be no lottery. But I think there are many tough days ahead.

USCIS might give lots of RFEs or rejection like they did last year applicants. Once you get RFEs, the process is long for 1 year approxy. I don’t want to discourage anyone here, but let’s think on other side as well.

Currently, I am happy that at least i cleared one step but there are few more to cover..!!

Because i got fooled like you all too, came here on H1B, was told i’ll get GC fast and live normal free life, but now all Indians applications stuck in Line, 10-12 years minimum wait to get GC, no promotion, no change of job, no freedom, just slaves, insecurity etc till that time, cant even leave and go back to india as too many personal issues, house, kids, loans, mortgages etc.

Enjoy this moment of H1B happiness but remember this is only beginning of a long long sad painful journey my friend.

@Pinkrose – I have to agree with what reality_bites have to say. H1B is just the beginning. Its long road after that. There are about 120,000 Green Card applications submitted just by Indian citizen alone and per eyar they issue only 10000 to Indian Nationals. Which means unless you have PhD and apply for GC in EB1 Category, you can essentially wait for another 10 years to get GC. H1B is valid only for 6 years. After that its real difficult process. H1B extension is problem, then you will have to think twice before you can travel outside US.
I would ask them to give details on why someone is frustrated and learn from their experience instead its not good to through words at them. Essentially you are goign to face the same problem reality_bites is facing now.

Thanks so much for the update! I’m very excited!

So it means the petitions received on the first 5 days were all selected right?

What if there are more Master degree cases received after the first 5 days and eventually reaches above the Master degree cap? Will this affect the regular (non-master degree) cases that received in the first 5 days? I hope not.

Also, what is the next step after receiving the receipt from USCIS?
Will they schedule an interview or something? How long will it take to know if you actually get the H-1B visa to start on Oct 1 after receiving the receipt?

Great news!My wife is excited.
have a query though.She is currently on H4 and applied for H1B.
She is planning for a trip to india in june – july.she is planning to come back by july 29.do u see a problem in case her H1b petition gets approved? she can come back on her H4 and doesnt require stamping – rite?

I guess u would have applied for a COS (Change of Status). If your wife gets the approval notice of the H1B before she leaves the country, she will be fine and will not face any problem. If she does not receive the approval notice within the date, she will have to go to another country to get her visa stamped to start working on october.

Your wife will not face any problem while returning back from India.

If your wife gets the approval notice of H1B before leaving from USA to India, she will not have to travel to any other country to get her visa stamped and her status will get converted from H4 to H1B on October 1st.

If she does not receives the approval notice before leaving the country, her visa will not get converted automatically from H4 to H1B on October 1st. She will have to get the visa stamped manually from some other country.

Jon – Premium processing will help you get H1b approval documents in 2-3 weeks after April 8, 2009. Regular processing can take 3 months to 1 year. Usually it will take 3 months. Talk to your attorney about premium processing. There is additional $1000 fee for the service.

Many thanks for your quick reply. Because the attorney hired by my company is dealing everything, and I don’t know the details. But the attorney ever told me that “if your case is selected for processing, the case should be adjudicated within 2 calendar weeks thereafter”. So I guess my case will be the “Premium Processing”.

So looks like I was pretty close in my previous guess-timate… I had predicted 50,000 standard cap and 15,000 masters cap.

Actual values ~35,000 standard cap, and ~19,000 masters cap.

Same thing happened today morning when I posted the update about Cap Not Hit – someone called their attorney and they said there is no official announcement from USCIS yet. Within 1 hr or so it was updated in USCIS. Just hang on for some more time, it will be all over the news.

Hi all and HSB,

I have a question regarding H1 B visa transfer.

I am an MBA graduate, and I did not applied for the H1 B visa yet. If I apply this year for 2010 H1 B visa, what are the transfer requirements? Do I have to do the transfer of H1 B visa to other employer just for the occupation I first applied?
