How Do I know if my employer applied for H1B Visa?

42,000 H1B Visa petitions were received under General Cap and about 20,000 in Advanced degree cap. But, how do I know if my employer submitted my application? First, why do you have this question in mind? I can think of couple of scenarios
- You applied through consulting firm and you could have never meet the employer in person, so you don’t trust your employer
- You could have had all the interactions with the employer, but not directly with the attorney
But, it all boils down to if you trust your employer or not. But in either case lets assume your employer’s attorney submitted the application. If you read the comments from last year, there were so many complaints of employer being not responsive to your email and is there a way to find from USCIS website if they have filed your H1B Visa application. There were few instances where employer’s company was shutdown after getting picked in the lottery.
Anyway, there are couple of way to find the answer
- Usually attorney will send the applications by express courier service, so they will have the delivery receipt
- USCIS have to issue Receipt Number to attorney, then it will come to your employer.
I think H1B petitions can be submitted electronically, in that case, delivery confirmation will be sent to attorney. I really doubt if attorney is going to give you the delivery conformation receipt. If you are going to ask that to your employer, it shows you don’t trust them. But, if attorney is representing you, not the employer, you can ask them directly.
Next option is to wait for the receipt number. For Premium processing cases looks like some are already getting H1B approval notices by email and also receipt numbers. So, next you will ask when will I get the receipt number for regular processing?

I have gone through all the comments, but could not found any reply to anyone’s query. Even though I am writing my query, someone please reply.
I too have applied for H1B during April’09 through a consultant. He also provided me the receipt number when I asked him. The USCIS site shows that Approval notice is sent for the receipt number. Now the problem is, being my employer a body shopper, I do not trust him too much and want to verify if the receipt number belongs to me only.
Anyone’s reply will be highly appreciated.
I have applied for H1-B for FY2010 and I received my receipt on 23rd April.
I am still waiting for a decision, my question is does USCIS picks applications at random or there are picked in the order they are received.

I am an H1b employee (foreign employee) of an company since May 1st, 2009 and I joined the company in May 1st, 2009.While joining we have an agreement signed between employer and me as employee and contract is valid for 19 months and in our contract company had also mentioned that they can terminate by giving written notice or verbal. My project goes on only till May 22, 2009.
Since May 22, 2009 till June 24, 2009 employer has submitted my resume to all over and same time employer has also arranged my interview on June 25, 2009 and I have also forwarded him few requirement to employer also in same period. I have all email communication available between employer and me.
On June 24, 2009 employer send me an (email and mail) by saying he has terminated me from employment effective from June 1, 2009. I have his email and mail which I have not opened up till now. After getting (email and mail) on June 24, 2009
On June 25, 2009 company official staff of the company they have arranged my interview also and I have that email to in mail email.
Employer has not paid me salary from May 25, 2009 to June 24, 2009 also and up till now.
1. What are options available in front of me to transfer my H1B visa?
2. Where I can launch compliant against this fraud or against employer and how.
3. Can go directly to department of labour to launch compliant against employer and weather department of labour will accept my case or not.
4. Can I use all employer official staff name in compliant application including employer?
5. I have also checked here in Pittsburgh USCIS office by visiting on June 29, 2009 and asked them weather my H1B visa status is valid or not and they told me my status is valid.
6. If I will launch compliant against company then anything will harm me.
7. Can I define in my application in details along with all email communications happens between all and from company with me. Can I attach all print out of all email communications in order and marked using pencil to show the email communication between authorized from company and me to the department of labour.
I am kindly requesting you please guide me what to do in above case to get my all money back. I am also facing lots of financial/mental problem due this employer.

I have received my receipt number from my employer, but can someone tell me how can i verify that the receipt number is mine only.
I search on the USCIS site, it does says that the receipt number is valid & in processing, but my name is not shown anywhere.
Please help.
The consulatnt who filed my H1b says that USCIS has encashed the check but still has nt send out the receipt. How can I verify,if that true?
Any idea what is the current application counts? What is the open category count? Last update was 42000…

Even if you meet the employer in person, some desi consultant make use of the USCIS process, what they do is they dont apply for H1B and take money from you… USe the money for their personal need and later in couple of months they say your application has not been selected in the lottery. As USCIS doesnt provide any particular # to track the application before lottery this becomes more easier for some desi consultant to play with people. Its only after your application get picked up in lottery u get the receipt # i.e LIN # depending on the location u application has been put forward. So, i would request USCIS to make this process more transparent by providing some number which can be tracked from April 1st. I am writing this because this has happened to me while I was in US and gave money to one of the New York Consultant… Thanks God he has returned all the money without any deduction. Another thing is that they dont apply and while returning they deduct 500$ saying this for processing fee. So please USCIS make the process more transparent so that this Desi consultant cant make fool.

the USCIS process is very transparent. The consultants need to be bagged and shipped back to their home countries.

I am also waiting for my recipt number? My employer said its called LIN number he has applied from Ohio. Is this correct info? by when can i get this Lin number? has anybody already received that number for tracking?
I have applied for H1b this year through a consultant.Now if i dont get a job there for 3 months…due to weak market conditions…then will i returned back by the US authorities as per the law.Do we have any other mean to stay there and keep on hunting for the job….Thanks
There is no 3 months waiting period. In H1B if you don’t have job, you cannot stay in US, unless your consultant pays you when you are in bench.
I applied last year 2008 for H1B on my bachelor basis as I was graduating in May 2008 with my Masters from one of New York school.
One of the Indian consultant from New Jersey applied for me and couldnt get through the lottery.Later I got the Job directly and this year(2009) I applied through my Employer.
The consultant took a deposit from me of $1250 and finally returned me $325 and rest money was used for attorney fee and my training according to him.
Is there any place where I can report this act of deceive or any way to make him realize that they should not do it with anyone else.

My employer, even without asking them, informed me of the Fedex tracking number for the petition that they sent so I was able to track it. They were very accommodating with that. I was filed thru regular processing so right now, I am still waiting for the receipt notice from USCIS. I know that my employer will inform me as soon as they receive that info. I hope that USCIS will approve petitions faster now than next yr…
