I am currently in US on L1 , but i am also having a H1 B petition which was approved in sep 2006.

I have never used my H1B,but now I am planning to shift to H1 status at the same time i am planning to change my employer, i only have the EAD no and no documents apart from that
is it possible to change my employer and change my status from L1 to H1.

L1 to H1B transfer

You can transfer from L1 Visa to H1B Visa. If you have H1B approval notice I797 form and recent pay stubs there shouldn’t be any problem. For H1B Transfer you will need recent paystubs, H1B Approval notice and few other documents. Without which H1B Transfer is not possible.

Looks like you don’t have H1B approval notice so it will be hard. If you can get a copy of your approval you can apply for transfer. You might want to talk to an immigration attorney who can help you with this kind if situation. Here should be a way to get additional copy of your H1B approval notice. But, I think to get that, you might atleast need to have receipt number to track your case. I’m not sure if USCIS can provide duplicate copy of H1b approval without h1b case receipt number.

Usually you need recent paystub from current employer who has your H1B visa. But, you are currently in L1, so I’m not sure who this situation will work. I strongly recommend spending $200 to $300 and get a consultation with an Immigration attorney, instead of posting requests and trying to get help from forums and blogs.

If you are not willing to spend $300 then you are simply putting your self into big trouble. In any case for H!b transfer, you will some attorney is going to send the petition to USCIS, but make sure your new employer know you dont have H1B approval notice with you. I would recommend to consunt an immigration law attorney and get all possible options that you have for L1 to H1B transfer.

Will H1B approved in 2006 be active?

f previous employed who submitted your H!b haven’t revoked the case, it should be active and since you got approval once, you will not come under quota. So, the bottom line is to get professional help from

I have h2b as a seasonal employee. I filed h1b april 2009 for 2010. It was transfer from h2b to h1b. Not yet any receipt or any kind of letters. What might happen to me and what should I do? Any idea?
