H1B Visa : 500 Multiple Applications Filed Last Year

USCIS had released Interim rules for H1B Visa 2009-2009 Fiscal year. New H1B Visa rules stated, employer cannot file multiple H1B visa applications for the same employee ( single person ). But, if you have 2 job offers, with 2 different employers, then both the employers can file H1B Visa applications for this year 2008-2009.
But make sure, you inform both the employers about 2 H1B Visa petitions being submitted to avoid any legal issues later on.
USCIS indicated they found approximately 500 instances of multiple filings last year. USCIS will now reject all duplicative petitions from employers who file more than one application for the same individual, even for different positions. The employer’s filing fees will not be returned. If the duplicative filings are not discovered by USCIS until after the random selection process, or even after approval, USCIS can reject/revoke all duplicative petitions later. Continue Reading…
