Yesterday President Obama signed the Stimulus Bill. As I said in previous article, new Bill will become law only after President signs it. It has both good news and not so good news.
Good News
New Stimulus Law will create millions of new job and provide Tax Break to Middle Class Families and improve America’s School system and infrastructure. Banks will receive money, so they can lend more to the consumers.
Bad News
New H1B Hiring Rules is in included in the Law. Which means, companies receiving money from the Stimulus Bill will be considered as H1B Dependent Firm and they can hire H1B Workers, but they are subject to very strict rules. There was some confusion, if new rules doesn’t apply to Exempt H1B workers. An exempt worker is one who makes at least $60,000/year OR possesses a Master’s or higher degree in their filed. Banks receiving funds have to follow new rules even if they hire exempt workers.
For a day there were rumors about New H1b Rules being removed from the Stimulus bill, but that was not the case. This rules applies to 2 years from now. I’m still trying to understand the impact of existing employees in those companies receiving bailout money. I’m trying to find answers to following questions
- Can current employees apply for H1B Visa Extension working in banks receiving bailout money
- Can they hire H1B Workers as contractors instead of Full time Permanent employees, through a consulting firm?
- What is the impact of this new law while filing for Green card

If you like America, you’re better off staying home until the economy improves. Students and Parents are furious that temporary visa students take spaces from citizens. Workers are furious that loopholes in USA immigration laws bought by Microsoft, designed by convicted felon Jack Abramoff, allow employers to bypass Americans and hire foreign workers exclusively offshore.
The foreign worker is NOT the person to blame – greedy corporations and corrupt politicians are at fault.
Congress is waking up to the H-1B and L-1 visa fraud and even former H-B proponents like Schumer have changed their tune and fighting outsourcing important businesses in NY to India.
Today, thanks to corrupt laws, American citizens laid off by corporations and replaced by temporary visa workers, most from India, have lost their jobs, homes, healthcare and life savings – with no end in sight.
The unemployment reports keep getting worse. I understand many USA student and work aspirants believe you are the best and brightest. If that’s the case, your country, not the United States, is the place to be and where you are really needed.
Please delay studying and working in the USA. It’s not a good idea, and it may not be safe. The US has a climate of rage and foriagainst foreign workers who have taken our jobs, homes, schools, life savings and insurance are the most visible target. God willing, this will go away when the economy changes.
The H1B visa program has destroyed the US consulting business. Clents in the past paid billing fees along with travel expenses. Now consultants with an H1B visa have no ownership in America therefore they can relocate to the clients location eliminating travel expenses. By doing so they are making it impossible for US citizens to compete in this market. US citizens like myself would have to give up our family responsibities, sell everything we own and go on the road to compete. Does this make sense or should we make it more difficult to obtain a visa if US citizens have the required job skills. Initially, the visa program was used to backfill jobs where there wasn’t enough US workers to perform the work. Now it’s to line the pockets of large corporations, consulting companies and those that lobby our government to approve and increase the number of H1B visa’s.
Companies hire H1B workers becuase they are skilled, smart, educated, mostly hardworking,…etc….there is no drama! We don’t slack around in the office, like I have seen most citizens do…..So don’t blame it on the Immigrant workers for your lack of talent and skills….look what the sneaky “deport the immigrant and we’ll take their job” caused America”….it is a disaster!!! I don’t think you are not aware that that USA is really the USA—>THE UNITED STATES OF AMERICA….STATES FROM ALL OVER THE WORLd BUILT AMERICA!….that’s what USA means…..
Brent is right. What fisseha tefera is talking about is what *used* to be the majority (most companies followed the purpose to get the brightest and best) case. This is now the minority case (most companies are following the purpose to get the cheapest and not necessarily best).
If you are a foreign worker, you will not be in favor of any reform that does not give you the advantage over a US worker.
I am an immigrant like all Americans who are born here in the USA from immigrant families. Let’s see-I agree with Brent, FIsseha, and powerfullfrog- but if you own a firm you will not hire someone who doesn’t have skills to work for you and your clients or the will to work hard to accomplish a task, do you?. I admire President Obama for standing for all people in the Uited States of America. It’s the Bush’s administration who destroyed the love between immigrants and citizens. He caused a misery and said, “Let’s Deport immigrants to create jobs so that the mess that I caused could be blamed on immigrants….”
We love America, and as long as we are legal and permanent residents of the USA we have all rights to gain any favor from every reform!

Based on the info gathered by my cousin who works as a PT in Tennessee, students from the US are studying PT for 7yrs. So that makes them in a masters degree. And I assume that you are from PI?

This is what we need to do to clean up all the contractors.
Recently the immigration dept has been rejecting most of the visa’s (new / renewal). One of the reasons given for rejecting the L1 Visas (company to company transfer) is “candidate does not work on proprietary tools”
L1 visas are only issued if the company in off-shore wants to transfer its employee to US to work on the proprietary tools that no one else or very few have knowledge.
That is why we are hearing big consulting firms pulling their L1 Blanket visa candidates back to India. Seems like all the blanket visas are now VOID.
This is what we all need to do.
If you know any contactor working on L1 visa at the client cite, inform ICE about it. ICE will raid the premises and will investigate.
Secondly, even H1-B are getting rejected, the reason given is “cannot do consulting on H1B”. I am really shocked with this reason. Well, this is what everybody has been doing.
You can also provide list of all these candidates to ICE. If possible provide the details of where they work. If you know where they live, ICE will raid the residence.
You can also complain about fake resume, degree etc.

I am a Fall 09 MS aspirant…will this bill affect my career when i come out of the university..u mentioned only about Banking jobs…how does this affect the Electronics Job sector as i am basically from E.C.E back ground…..Also right now i am in my final yr of engg. Recently got placed in T.C.S in these conditions is it worth leaving my job & come to US?
From my understanding, rule applies only to Exempt H1B workers? What does this mean for current masters graduates. Could you provide a more detailed explanation.
