Now there is No H1B FY 2010 Lottery – What Next?

Now, there will be just mini lottery, there are many questions that have to be answered. But, you can find answers to the questions below if you read all the H1B Visa related articles in this blog. But, I doubt someone is going to read some 100+ articles from last year H1B Visa lottery. But to make things easy for you, in next couple of weeks, I will write answers to following questions

    I applied for First time H1b for FY 2010 .Now i have got approval.
    But My H1b is approved for only 2 years.I asked my employer for the reason and they told me that they filed my petition for 2 years only. As they say it was difficult to get 3 year approval this year .
    They say that we had informed you about this at the time of filing the petition , which is not true.

    Now what should i do.

    can this approval be increased for 3 years
    is there any way like filing amendment petition to get it approved for 3 years.

    will a 2 year approval cause any problem during visa stamping.

    Will a 2 year approval cause any problem in future when i will go for further visa extension.

    Hi guys.. I am applying now for Regular H1B PP ( in July 2nd week ) . Being sooo late what are my chances of approval. I applied in 07, 08 denied. My lawyer told me USCIS still not reached to 65k cap.

    Can we submit existing contract/agreement copies of project in support of query/RFE. My Employer is saying he can’t submit client details in advance, as it expecting for Oct-09.

    Hi,

    My employer said they received RFE (Request for Further Evidence). Is it something bad? He said yes it is bad and i may get rejection? But they would do all possible to get it approved.

    Can any one tell me in what cases one will receive a RFE? Is it because the employer did not file the petition properly or is it the USCIS who is tightening its rules and just do not want to approve some of the visas?

    Can any one please suggest me something here? That would be very helpful. I am very worried now.

    And I have got my reciept number,and now my consultont has got the document saying INS query.Means you should say about your future employment and where,when or with whom I’ll work..

      Yes, there is a chance of Denial if the Visa Officer found out that one of your

      1. Degrees or
      2. Experience Certificate or
      3. Sponsoring Company (especially true in case of Shady Consultancy’s)

      is FAKE, they can reject the H1B Visa.

          The Shady Consultancy if found to be indulged in FRAUD is blacklisted by USCIS and banned for 5-10 years from sponsoring any candidate.

          Same is the case with candidates. The H1B Seeker can be barred from entering US for 10 or more years.

          Yes, you can take your spouse and/or dependent kids to the interview. It does NOT have any effect on outcome of the Visa Interview.

    I had a question regarding the OPT.
    I have finished my masters and applied for OPT. But I am planning to do mba in fall 2009 which means I will have to cancel my opt. The rule says that between 2 masters i can only apply for opt once. I would like to know after my mba what route should i choose to go about working for a us company does it mean that i need to have h1 after i graduate in may 2011 from mba and how long can i stay to find a job. I would really appreciate if ny1 could help me with this. thanks

    Please advice me. I really need valuable advice and sugesstions. I have rejected thrice for student visa (F1) in the years 2004 & 2006 in chennai consulate for MBA course. I have applied for H1b visa from last three years but due to lottery system, my application was not selected. Lucky this time due to less number of petitions. My application is accepted and waiting for approval.

    Can you please advice me..Will F1 Visa rejections will effect H1 B Visa stamping, if i went for stamping. Wht questions will be asked related to F1 rejections and how to answer.

    I am very much confused, my friends told this will not effect becoz both are differenct type of visas.

      Hi Hussain,

      I dont think there is any link between tour F1 visa rejection and your H1B visa. they will ask you about the same questions like why do u want to go to US bla bla ……. For what job did you apply for the visa for? did you apply through consultant????

    hi.. my consultant has told me that my h1b petition has been approved . also that the process is going smooth and according to plan. is it true that despite all , i cannot enter U.S before 1 october 2009 ?? and when do we generaly apply for a visa at the consulate.??

      You CAN only enter US 10 days prior to your Employment Start Date which is mentioned in your I-797 Approval Notice. In most cases it is 1st Oct, So you cannot enter US before September 20th.

      You can apply for H1B Visa Stamping at the designated consulate (which is mentioned in your Approved I-797) any day after your H1B petition is approved. Remember you need to have the Original I-797 Approval Notice to apply for the H1B Stamping.

        thanx alot for da info punit.. also my consultant has got filled form L-129 from me. do you know any such form required in the H1B process ??

        They have also told me that i need not apply with the consulate and my visa will be sponsered from U.S only, i shall go to the consulate for stamping only on the date they call me.
        Please help as i am highly cofused and invested lots of time& money in this proces..

          I think you are talking about I-129 , there is NO L-129 form.

          Yes, you need to present the following docs during your H1B Visa Interview.

          1. Form I-797
          2. Form I-129
          3. LCA
          4. A letter from the petitioning employer that confirms their plan to employ me and outlines my proposed duties. Client Agreement if you will work at a Client Location.
          5. DS-156 & DS-157 (You can download these forms from US Embassy Website)
          6. Original Degrees / Certificates
          7. Marriage Certificate if you are married and your wife is also applying.

          As for scheduling the Visa Interview : Go to https://www.vfs-usa.co.in/Home.aspx and schedule a Visa Appointment.

          If you are applying a US Consulate in Hyderabad, there are some extra documents required, which you can find here

          My Visa was also approved on May 26th and I will book a Visa Appointment next month at US Embassy, New Delhi.

      If you have all the documents with you and if the interview goes well, you can get the passport with H1b Visa in couple of days.

      Answer : Anyday within 10 days before your employment start date.

        Yes, it will be better if you can go for Stamping with your wife and you can travel when you employer is asking you to go to USA. But, 10 to 15 days for stamping before Oct 1 and anytime after stamping.

    Hi guys,

    I have a question. There were two people who applied for H1b visa through our company this year including myself. We both applied through the same lawyer hired by the same employer on the same day. I already got my receipt but haven’t gotten approval or denial yet however the other person who applied through my company already got an approval.

    Does this mean I probably got rejected? Because we would have heard around the same time if my case was approved as well? Seems like apprval notices are sent way before rejection notices, speaking from the last year’s experience.

    Hopefully everyone got their answers from all the great responses by people here. There are so many mistruths with the H1B visa that clearing them up for people is important to remove fear.

    My lawyers submitted my application on 1st April under premium processing for bachelors degree and we have still not had a receipt number yet. I thought we would have to be notified by now. Is the 15 days the amount of time they have to send a receipt? Is there many more people still waiting on a receipt? Without a Receipt number is there any way to find out if the application was definitely received?

    Hi.
    I have a basic question but not positive where to ask. After approval, and stamping, (first time h1b), when can I travel to US? I ask this because I have read someplace it is 45 days and at another that it is 10 days prior to the position start time of Oct 1. The reason for travel would be basially to set up house, (find one) arrange transport, etc and become accustomed to the area.

      Answer is 10 days … Read below for details…

      You can apply for an H1B visa upto 90 days in advance beginning of employment status as noted on the form I-797, Notice of Action, however your entry to the US is restricted to 10 days prior to the start date as noted in the Form I-797 unless you are already working on an H1B visa and have applied for a revalidation.

    I have a question, I’m on H4 living in USA but my attorney applied my petition under consulate stamp. IThe petition says that I will use my country Consulate (Venezuela) but I also have European Citizenship (Spain) Can I go to Spain to get the stamp on the Spain passport instead of used the Venezuelan (wich was the one I used)

    How is that process??? I have all my possitive energy with my but is kind of stressfull. Can anybody explain me how this works?

    Now that the cap wasn’t reached, and applicants are waiting eagerly for their receipt numbers or approvals, is there any reason that a
    genuine applicant could be rejected?

    I have a very supportive team at my workplace and everyone’s concerned about my H1-B. During the first seven days of April, I tried very hard to not think about the cap and lottery because until the official release, everyone was only giving their personal opinion and it was just a waste of time to ponder upon the unknown. Just when I had kept my mind off the whole H1 thing,someone would pop by my desk and ask about the visa.

    They were very happy for me for the lottery situation, but my anxiety isnt over until the visa is actually granted.

      I too replied under Regular Processing, but haven’t heard anything from USCIS yet. But if we notice USCIS processing times during last few years, it takes them upto 2 months to send receipts to applicants who file under Regular Processing. So it will be last week of May or 1st week of June. Hope, this time it will be quicker, as they have received less applications.

Is there a chance that they will approve my petition earlier than the 3 months stated before since they have received less applications today than last year? Are they starting to evaluate petitions filed thru regular processing now or will they finish first the ones filed thru premium processing? My cousin was filed thru regular processing last year and I think she got approval notice in July. I hope I could get approval notice sometime in June. Thanks again!     Here’s a good one, something my friends had debate on….

    So say if someone is rejected the H-1B Visa then is he eligible for the OPT extension for the 17 months?

    Reason being, if he is rejected the H-1 then it means he’s not qualified for some reason to get the visa then in that case will it make sense to give him the extension to file for H-1 the following year.

    This was the hot debate, in which i was not so much involved.

    But logic aside I think by rules its mentioned nowhere that a H-1 reject is not eligible for OPT extension, for that matter it only states that he/she should be employed in an E-verify comapnie and few other stuff, but no mention or connection of H-1.

      Well its interesting that someone has actually talked about this. I read the whole interim rule and found this stupidity too. I mean what sense does it make to give someone a rejection and then make him apply again.
      The only logical explanation would be if you are rejected they dont give you your money back. ONly if you arent picked in the lottery for processing( at least thats what i think) and the more number of times you apply the more they make, simple.

      Thats what they did with green cards isnt it. Who ever was stuck with the i-140 labour aproval got their aproval and is stuck on teh EAD stage, so they got EADs but they have to renew every year..

      Now its different that once rejected you might find some other way with some lawyer to get through..

        Well I talked with my immigration lawyer and As per murthy.com also we can file multiple h1b through multiple companies……….the new press release is resticated only for filling multiple h1b through same company……..so its clear now…….

          Raj,
          Thanks for your reply. Suppose I get my H1b visa approved for company A and B but then then decided to work for company A and turn company B down. Before filling for my H1b company A made me sign a contract that if I turn down the approved petition I will have pay back the processing fee of around $2000.

          Company B said that before filling my H1B, that no other company must file my H1b and this was just confirmed by email and not a written contract.

          Now the question is that can company B fine me for not been with them or work for them.

      NS,

      Are you applying for a change of status (COS) also (say from F-1 to H1-B)? If so, it is not advisable to travel internationally. If you travel outside the country when the COS application is pending, the COS application will be considered abandoned. I don’t have the official USCIS link, but doing a google search with keywords “change of status pending h1 travel” returns many results.
