H1b Visa 2009 Loopholes: Senators Questioning Top 25 Companies

After Bill Gates presented to the congress, two new Bills were proposed to increase H1B Visa to 130,000. Following that USCIS released Interim Rules regarding H1b Visa 2009 filing procedures. Finally, long awaited April 1 2008 arrived and lots of buzz is still around how many H1B applications was submitted on the first day of filing. The American Immigration Lawyers Association (AILA) expects more than 150,000 H-1B applications to be submitted. USCIS haven’t released the number of H1B visa 2009 applications received. United States Senators Dick Durbin (D-IL) and Chuck Grassley (R-IA) have always opposed to increase the number if H1b Visas who compete against American Nationals and that tends to lower the wages paid to the workers. So, both the senators trying to find out if companies are exploiting the loopholes in H1B Visa program.

Senators Dick Durbin (D-IL) and Chuck Grassley (R-IA) have reported to sent a letter to top 25 companies received H-1B visa petitions in 2007( List of Top 200 Companies received H1b approval ).

These firms were responsible for about 20,000 of the available H-1B visas last year.

Some of the Questions are

  • For each of the last five fiscal years, how many U.S. citizens, H-1B visa holders, L-1A, and L-1B visa holders, and other foreign nationals have you employed in the U.S. and outside the U.S.?
  • If you have employed other foreign nationals in the U.S., please specify the type of visas held by such nationals. For each of the last five fiscal years, how many people have you employed in the U.S. and outside the U.S.?
  • Please provide a detailed description of your recruitment process for open positions, including any relevant company policies and where you advertise.
