59,100 Regular - 19,500 Masters H1B Visa Petitions Approved - Update from USCIS

This article will be welcome relief for many H1B Visa Applicants who are still waiting to hear from USCIS about their H1B Visa application status. Many readers of this blog are status ‘Case Received and Pending’ and many have received RFE and waiting to hear the H1B visa approval results.

USCIS have released some numbers that will help you understand more about whats going on and how much more applications to be processed and it might not be good news to few who are still waiting to hear. If you were wondering if there is a deadline to know when H1B Visa will be approved, answer is no.

USCIS Update on H1B

To date

  • Total H1B Petition Approved -  59,100 petitions under the regular cap
  • Pending approval - 9500
  • Master’s cap approved - 19,500 petitions
  • Masters Cap Pending -  2100

This accounts for 92% of the regular cap allotment being reached already and 97% of the master’s cap.

95% of the regular cap petitions have been touched and 94% of the master’s cap petitions have been touched. That leaves 3500 petitions untouched for the regular cap and 1400 untouched for the master’s cap. USCIS expects to get to all of them shortly, but it may not be by October 1.

What this H1B numbers means to you

Some 3600 H1B visa applications selected in lottery will not get H1B visa approval notice. Getting selected in lottery is one big step towards getting H1B Visa, but getting to know, about rejection after 7 months wait is tough to take, but thats life! more about this update from USCIS

    Well, I also have applied for H1 2009 quota and received an RFE. Since May 19, 2008 the status is not changed. It is really so frustrating to wait and watch to know the status. Can any body tell me, what could be the max time that is possible to get the status on h1 approval?

    I am US citizen with a MS in Computer Engineering and Electrical Engineering. If I apply for a position as H1B , will this improve my chance of getting an entry level job with a US firm.

    @John: H1B Visa is applicable only to Non US citizens. If you are finding hard to get entry level job, see if you can volunteer job in your field and work for 1-2 months, that will give you experience to search for permanent position. Also, you can search for temporary jobs. Start building your network using LinkedIn.com.

    I also got RFE but now its 70 days still it shows
    Current Status: Response to request for evidence received, and case processing has resumed.

    On August 25, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our VERMONT SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case.

    My status - Response to RFE received on July 15 and case processing has resumed.

    The last updated date changed on oct 17, again on 18 and now it shows oct 20.

    My employer says background check in progress.

    Mr. Raghu, please tell me about my chances of getting the visa.
