I saw this comment few minutes back and cannot believe I’m seeing such a comment about H1B Visa and RFE.

My H1B renewal status is ‘Request for Additional Evidence’. I need to go to my marriage in India in 2 days. Can I go before I get my H1B approved? If I go, will this H1B renewal processing get void? I know I need to have petition and stamped visa to re-enter in USA.
I am so worried about this status because I can not postpone my marriage and I can not come back without new H1 petition. What should I do? What is the law?Thanks.
Prasad, you should be asking this question to an immigration attorney. Talk to an immigration attorney or to the same attorney who have submitted your H1B visa application. If you are not getting proper response from them, talk to well known immigration lawyers like Murthy.com. But, you should have done that long back, not 2 days before travelling to India for Marriage.
I don’t know what is your situation, but get an appointment with an attorney right away. You will have to pay the fees for advise, but I think that’s worth spending, than spending time looking for answers in web.
Having said that, if your current H1B Visa is valid, I think you should be good to travel. You will run into problem, if your Visa stamping is expired and RFE on H1B renewal might get you in trouble.
I’m not an immigration expert and haven’t come across such situation. I hope you find an answer soon. I would appreciate if you can let us know what did you find. Good luck.

It has been 15 days since I sent USCIS the response to RFE. I think the RFE was for an updated form. How long does it take for USCIS to respond to my response to RFE?? My petition was filed under regular processing. Can it take months for them to respond? Will my status first change to ‘processing resumed’ or will they directly post a decision? Can they send more RFEs after this one? I am really nervous because I need to travel outside US (I am currently in US on OPT which expires end of June) in first week of July. Please respond!!!
