RFE on L1 Visa

in General

Companies are trying to send employees to U.S. through L1 Visa. Since there is no quota restrictions on L1 Visa, companies started looking for H1B Visa Alternatives and L1 Visa costs much less then H1B visa.

L1 vs H1B Visa

For submitting H1B Visa, it costs $2,200 in USCIS fees and around $800 or more in Immigration Attorneys Fees. But, for L1 visa it costs around $300 for application.

RFE on L1 Visa

L1 visa is typically issued for 3 years and it can be extended for 2 more years. I have been reading recently about USCIS issuing RFE on L1 visa. Making it difficult for companies trying to send employees to U.S. Unlike H1B visa where spouse on H4 visa cannot work, L2 dependents get EAD and they can work.

If RFE is issued for L1 Visa, then it might take longer to clear the verification before companies can get to send the employees to U.S. There are chances where L1 visa application can be denied.

Its already December and time to start articles for H1B Visa 2009/2010. Still there are many applications waiting to hear from USCIS about lottery results.
