RFE Query – H1B Visa Petitions

USCIS will issue RFE on H1B petitions if they need more information from the employer. We had written about RFE in previous articles. Instead of writing another article explaining RFE on H1B Visa, you can refer to existing ones

If you receive RFE status in USCIS website will say something like this -

On April 13, 2009, we mailed a notice requesting additional evidence or information in this case I129 PETITION FOR A NONIMMIGRANT WORKER …..

    I got RFE on Aug 25, 2009. My receipt date was 22nd May, 2009. They are asking my employer for the Job ad and description, my lawyer is saying they want to verify that a bachelors degree is minimum reqd for the job, but in the job ad, there was no requirement, but it said reqd. 2+ php experience, so i m not sure what would happen ab the same. Has any got RFE for the same. Also my lawyer asked me to write a description of the duties you do and relate it to the bachelors and MS coursework.

    Hi

    i got my receipt no. and when i check in online website, i see the status as follows

    “Request for Additional Evidence Sent”

    Any idea what does this mean and who will receive request for additional evidence. i checked with my company and they still havent received anything from USCIS.

    Has anyone got a similar status.

    Also could anyone share from past experience what kind of info. does USCIS usually require in such cases.

    RFE Question. In the website, when I check the status, it says, they mailed RFE on April 13, 2009. I applied with Premium Processing. My question, whoever received RFE or knows, did you get RFE by mail or fax? How long it took after they ‘mailed’ RFE? My processing center is CALIFORNIA. Why would it take so long for mail to arrive? I am really worried, because it will delay everything and things will be pushed back. Please help!!!

    i was also filed thru regular processing and until now, no news abt the receipt notice… i think we all just have to wait for that. Last year, they send receipt notices for regular proc. around MAY. so.. all we have to do is WAIT WAIT!

    Has any body received the approval from USCIS under normal H1b processing till date…..If So then what come next….

      Still waiting for my receipt (regular processing). After approval receipt, if you outside the US, then you will have to apply for h1b visa to enter US. If you are already inside the country, thats your last step. You can just wait until October, 1, and start working, or if you are an F1 student on OPT, then you can keep working until October, 1.

        That is not correct. If you are already in the US, you still have to go out of the country to get an h1b visa stamp. That will be changing from F1 – H1. So getting approval is not the last step.

          If you within US, after H1B approval with change of status, one can start working from H1B start date. You are legally authorized to stay in US as long as your I-94 is not expired. You will get new I04 with H1B approval. But, if you have to leave the country and come back to US, then you will need to have stamping.

    Hi Everyone,

    I have a different kind of problem.

    My company applied for my H1B on April 2008 and i have received an approval notice (June 2008) from USCIS saying that my petition has been approved and mailed.

    Here’s the problem i received an RFE last month (March 2009) requesting for evidence. Is this possible that after approving my petition the USCIS can query my case.

    If someone is aware of such kind of problems please let me know what my further steps should be. I am in a fix and need help.

    I work full-time for one Big software company. My petition was filed under normal category (not premium processing). I still have not heard any update on my case from my lawyer.

    What should I expect now in the process? Should I be getting the Receipt first or directly the approval or anything else?

    Please Advise.

    I have applied for H1b visa but I am under Bachelor’s.
    Also I am french Do you know anything about quota by country ?
    My lawyer send my application the first day April 1

      Do not worry. Since less number petitions come this year, quota does not matter much. All the best for you.

    Hi, I have applied for H1 B visa under Master’s. My employer is a small company with less than 25 employees. What are the odds against getting my visa approved?

      No, My company status is the same as yours and i have been approved with H1B.

      I am waiting for physical approval from USCIS.

        Thanks Simon. Thats a positive piece of info for me. Did you receive an RFE? My company is so small that they dont have a website or havent even sponsored any one before, so I am a bit apprehensive.

          My sponsoring company is also small. Its 3 Years old, 10 employees with $1.2 million revenue last year. My application was filed on April 1st under Regular Processing. Haven’t heard anything from USCIS yet..!
