As of August 14, 2009, approximately 45,000 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.
Previous Update – H1B Visa 2010 Cap Count update was on Aug 7, 2009. In last 12 days looks like USCIS have received 100 applications under General H1B Quota.

I am graduating in may-2009(masters) and working on pre-completion opt. My company filed my H-1 in regular quota (as i was not graduated by April 1, 2009). submitted my first I-20, OPT I-20, EAD card, license, 10th, 12th mark sheet, bachelor degree transcript. Now, filing in regular quota and being in US will it help me getting my application approved?
I didn’t receive receipt no. from my employer, this year there is no lottery, how come delay in receiving my receipt no.?please reply asap, i am so eager.
H1B Approval Chances
Riz, living in US doesn’t increase your approval chances. In current economy and due to latest H1B Fraud, USCIS are looking for more fraudulent activities in H1B Visa applications. So, applying for H1b Visa through an employer who have good credentials will get your application approved. If in case there happens to be query (RFE) on your H1B Visa petition, your company should take of the problem.
There is a discussion going on where few have paid money to apply for H1B Visa and employer is not responding to their queries or giving the receipt numbers. You can avoid such cases by applying within US. You have the option to hire an immigration attorney and report fraud activities in that company. But, if you stay outside US, it can be still done, but process will be difficult.

As of May 29, 2009, approximately 45,800 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) today announced information on the number of filings for H-1B petitions for the fiscal year 2010 program.
USCIS has received approximately 45,500 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. The agency continues to accept petitions subject to the general cap.
Additionally, the agency has received approximately 20,000 petitions for aliens with advanced degrees;however, we continue to accept advanced degree petitions since experience has shown that not all petitions received are approvable. Congress mandated that the first 20,000 of these types of petitions are exempt from any fiscal year cap on available H-1B visas.

Can anybody tell me the FAX number for faxing the TARP form to CIS?
Also where I can get that TARP Form?

You have to find a new attorney, if your current attorney is not responding. How did you get the RFE details if you cannot contact the attorney?
New Immigration attorney should able to help you in submitting the new form to USCIS. Why do you want to take the risk by doing it by yourself?
5 Reasons Why You Haven’t Received H1B Receipt Number

Recently most of the comments are from the readers who haven’t received the receipt number. Even though they can find the answers by following or reading few articles within HSB. Most of the readers read 1 article and comments within that and post their questions.
If you are new to this blog, you have to spend 20 minutes or so reading all the related articles to H1B. Chances that most of your common questions are already answered. Well, not many are going to read this article too.
H1B Receipt Number
If you haven’t received the receipt number for your H1B Visa Petition for 2010, it could be one of the following reasons
- USCIS haven’t processed your H-1B Petition
- USCIS sent receipt number to the Attorney, but Attorney haven’t sent it to the employer.
- Attorney sent it to employer, but haven’t the Employer haven’t informed you.
- Employer received the H-1B receipt number, but you haven’t checked with your employer.
- Employer have the receipt number and not willing to give it to you.
When Will USCIS Send Receipt Number
If you look at latest H1B Receipt Number, it will have Received date of April 7, 2009 and Recipt Notice Date of late in April ( Like April 22, 2009). So, chances are your case is not yet processed by USCIS. Best youc an do is follow others who have submitted the Petition in H1B Visa 2010 Processing Time Tracker and post your status too and keep positive thoughts and wait. U.S. Citizenship and Immigration Services (USCIS) today announced an updated number of filings for H-1B petitions for the fiscal year 2010 program. USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. The agency continues to accept petitions subject to the general cap. Additionally, the agency has received approximately 20,000 petitions for aliens with advanced degrees; however, we continue to accept advanced degree petitions since experience has shown that not all petitions received are approvable. Congress mandated that the first 20,000 of these types of petitions are exempt from any fiscal year cap on available H-1B visas. For cases filed for premium processing during the initial five-day filing window, the 15-day premium processing period began April 7. For cases filed for premium processing after the filing window, the premium processing period begins on the date USCIS takes physical possession of the petition.
