Latest H1B for 2012 cap count was released by USCIS (May 6).  During the first week of May, USCIS received 1,000 H1B 2012 cap subject petitions and 700 H1B petitions for Masters cap.

H1B Visa For 2012 – Cap Count

  • General Cap -  10,200 H1B petitions
  • Masters H1B Cap – 7,300 petitions

The number of H1B Visa for 2012 petitions filed each week for General Quota (65,000 cap) is approximately 800 to 1,000.

The number of H1b Visa for 2012 Masters quota (20,000)  is approximately 600 to 800.

At this current pace of H1 Visa filings, the Master’s cap could be reached by the Fall this year.

H-1B regular cap numbers should remain available until at least the end of this calendar year (March/April 2012).

I am working under OPT. If I wish to apply for H-1B (FY 2012) in April, can I still work under OPT until October 2011?
In General, from the time I apply for H-1B till I receive an approval/rejection, can I continue working under my OPT?

Applying for H1B Visa 2012

You will apply for H1B Visa FY 2012 sometime in April of 2011. Assuming you have received OPT, you can continue to work till your H1B visa is approved . If your H1B is approved, then your status will change to H1B. There can be two possible scenario with your OPT status as follows

  • Valid OPT – If your H1B is denied and OPT is valid, you can work in OPT till your OPT expires.
  • Expired OPT – If your OPT is expires before October 1 and haven’t heard about H1b approval status before October 1, then you cannot work till only till October 1 under cap-gap rule.

Get the latest information about H1B Visa FY 2013 (USCIS starts accepting from April, 2012)

H1B Visa season is yet to start, but looks like someone who is planning to apply for H1B Visa 2012 (next year) heard some rumors about the H1 program as such.

I’m planning to graduate end of this year and if I get a job, I will apply for H1B Visa 2012, but some of my friends said, USCIS is planning to lower the H1 Visa numbers for 2012 year and they suggested to apply this year or I might not get H1 Visa at all. Is it true? What should I do?

Important Dates – H1B Visa 2012

  • Previous FY 2011 H1B Visa reached as on Jan 26, 2011.
  • H-1B Visa 2012 petitions can be filed starting April 1, 2011
  • Applications filed after April 1, 2011 will have start date of October 1, 2011 and later.

H1B Visa 2012

As of now there is no change or any news about H1B Visa quote being canceled for Fiscal Year 2012. As with any rumors, looks like you have heard another rumor.

Don’t change your graduation plans because you heard some incorrect news. You never know how Immigration laws in US will change and what additional restrictions will be placed on H1B program.

If you plan to graduate in Dec of this year, then go ahead with that schedule, but make sure you try to work as in intern for atleast 2 semesters and apply for OPT in time. Start your job search atleast 6 to 8 months in advance. If you find a direct employment, then it’s very easy to get H1B Visa 2012.
