USCIS Issues H1B RFE Query for Small Companies

Many applicants from last year April 2008 H1B applicants know they received RFE on their H1B Visa application. There is an interesting article on USCIS policy to issue RFE for small companies applying for H1B Visa. But what is defined as Small companies?

Small Company

Small company is defined as follows

  • Gross Annual Income less than $10 million
  • Company claims less than 25 employees
  • Company established for less than 10 years

So, the next thing that  most of you will do after reading the above definition would be to find out if the consulting company or your direct employer fall under small company category. Good luck finding that information.Checkout the interesting discussing going on at the article H1B Visa 2010.

Hi,

It’s not that USCIS issue RFE small companies H1 transfers. It’s that USCIS are issuing RFE’s but for incomplete H1 transfers and not for a transfer with a real (existing) project. Even if a guy gets RFE with a real project. He doesn’t have to worry at all. As he is in a project he can provide all the necessary documents and he can resolve the quer easily and it doesn’t require more than a week where the USCIS will give you around 30 days of time to respond.

IS there a list of further documents( other than I 797,.. etc) that I need to take with me for visa stamping if i apply through a small company ( a staffing agency )

Well, if you are from small staffing company, please be careful at interview. Carry good paper-work, Client-letter, W/o number etc.
Better still, check the company on website, if it is under investigation by DoL or USCIS.

Basics Checks=>
1. LCA and go through it in details.
2. Where did you got Qualifications etc.
3. Your Paystubs and employment letter to show that you are Qualified.
4. Nature of your work… What work are you supposed to do in USA?
Basically they will try to make sure that…. you are not threat to american jobs.
Simple as that.//
