USCIS Rejected 3 H1B Visa 2010 Applications on April 1, 2009?

in H1B Visa

This is interesting. H1B Visa FY2010 season started yesterday. Still USCISĀ  haven’t released any information on number of H1B Visa applications were filed so far for FY 2010, starting on October 1, 2009. But, there is an interesting comment posted to the article H1B 2010.

Yesterday (1st April) itself USCIS called my employer and questioned the employer that in this week economy how can they make a request for H1-B. My employer filled 3 h1 this year and USCIS has rejected back all the three application.

Can above H1B Rejection be True?

Well, unless there is any official information from USCIS to media, there is no way one can confirm the validity of the information. So, it can be either true or just another rumor about this H1B 2010 season. 2 days have gone and USCIS is yet to release any updates about H1B Visa petitions received.

If in case above said information is true, then most of the companies that applied for H1B Visa will have long wait and sleepless nights. So do the employees who have applied for H1B Visa. There was an article about USCIS targeting small companies by issuing RFE on H1B Visa Cases. Small companies were defined as follows

  • Gross Annual Income less than $10 million
  • Company claims less than 25 employees
  • Company established for less than 10 years

If there is any information released out to news media by USCIS, we will update it here in Happy Schools Blog. That should be good news, if true, for those who have applied this year. Usually CA center gets more than half of the apps. This should mean that we wont hit the quota until April 7th. I am keeping my fingers crossed. What do you guys think??

Really? So, that means the quota won’t be reached! I am praying so hard for that. I hope that all h1b petitions will not be subjected in a lottery.

I got my bachelor degree two year ago and my OPT ended a few months ago. Right now, I am doing my graduate program and I also applied for H1B. If selected, Can I work and study simultaneously or is there any issue for me moving from f-1 to h-1b?
