VSC Relaxes H1B RFE Requirements for Consulting Companies

H1B Visa application for FY 2010 by consulting companies received RFE on H1B 2010 applications. Still many are waiting to hear from USCIS about their application status after employer responded to RFE request from USCIS.

New RFE Requirements

Murthy.com had a report on relaxed documents requirements on RFE requests revived on H1b Visa 2010 applications submitted by Consulting companies to Vermont Service Centers

  • The U.S. Citizenship and Immigration Services (USCIS) will not accept a statement regarding the duties from the petitioning consulting company alone.
  • The VSC confirmed that a letter from the end client is acceptable as proof of the specific assignment.
  • According to the VSC, it no long requests these contracts in its RFEs.

This new requirements should make responding to RFE bit easy, since consulting companies are not required to sybmit the actual contract they have with their client, which may contain confidential information.

RFE dated on Aug 21, 2009 due by Sept 20, 2009, RFE sent by Sept 20, 2009 via premimum processing….now 10/02/2009…. OPT with CAP-GAP extension EXPIRED…. no information on H1B status. What should I do ?

Did u hear anything back from them? Any idea what’s the normal time it is taking for USCIS to normally respond to an RFE?
