USCIS will send receipts dated April 7, 2009 to all the applications it received till April 7, 2009 since there was no lottery. Looks like they are already approving H1B 2010 visa petitions submitted through Premium Processing and issuing electronic approval notices. I guess this is something new from this year.
For regular processing, you should be getting receipts in next couple of weeks. Receipts will be sent to your employer’s attorney and they will forward it to your employer. So, keep checking with your employer.
15 days Premium processing period for case received till April 7, 2009 started on April 7, 2009 and so far I have heard couple of them already received H-1B Visa Approval notices (I 797).You may have to subscribe to comments updates or frequently check the comments for recent H1B related articles, many of your questions are already answered by others comments.

My H1-B was applied for Nov cycle of 2009, My employer says the petition doc was sent to USCIS on Dec 1st 2009, so it wont go through lottery. But the problem here is I have not received the receipt copy ( I-797) till now. As per the employer the check is not encashed but we have to wait for the receipt copy. I really doubt on my employer’s word as its been more then 4 months the petetion doc was sent to USCIS but no receipt copy till now. Folks please let me if there is any hope for getting the receipt copy.

I have not got any receipt number from USCIS. Further check is also not encashed yet. My employer says that we might have to reapply. What needs to be done? Can we wait for some more time?
call service center and ask for the staus of ur application… sometimes they misplace applications so better apply ASAP again and also send a letter saying you applied in april and attach proof(post office receipt or courier) …..

Look at the back of the cheque encashed, if it was your personal check. Or ask your employer to do that if it was employer’s check.

No, it only guarantee that your file will be processed. There is NO Guarantee that you will get the Visa.
As far as Receipt Number is concerned, you can get it by seeing the reverse of the en-cashed cheques.
Request you employer to login to Online-Banking Account and see the reverse of the encashed cheques. USCIS write the Receipt Number on Reverse of Cheques.

I have already posted saying that my status is “Case received and pending”. I got the receipt dated 21-April-09. Today when I checked for the status in USCIS web site, it is showing “Request for Additional Evidence Sent” on 7-May-09. What are the possible reasons for this? I haven’t got the RFE notice in hand yet. I am very much confused of what happens next. Can any of you please help me in this?

An RFE is a request for Evidence. I too got one earlier this month and I’m in the process of answering it.
Don’t worry. Getting an RFE means, that they are still giving you a chance to answer any questions they might have.
Ask your lawyer for the RFE and what it says when it comes and try and answer it as soon as possible!

Once you send out your application the process is as follows
1. You get a receipt number. This means that they have accepted your application for consideration and they have received all the fees associated with the visa. This does not serve as any kind of guarantee.
2. This step is optional: You will receive an RFE. RFE stands for request for evidence. This does not mean your application has been rejected. It means that they just need to be clarified on certain points of the application, which is why they want more evidence before they can make their decision.
3. Acceptance or rejection based on your application materials and additional evidence (if they asked for it)
Getting anxious never got anyone anywhere (esp in re: to visa application processes). You’ve received your RFE, answer it with your lawyer to the best of your abilities, and then let it go. There’s nothing you can really do about it, and getting nervous will only be a waste of your time and energy. Enjoy!

No, Receipt Number is NOT a Guarantee that you will get the Visa. Its only an acknowledgment from USCIS that they have received and processing your application. You will definitely get the Visa if your sponsoring company is genuine and all your supporting documents are correct. Cheers…!

My attorney called me on Monday to tell me they have my receipt. I have a copy now and it says “Notice Date” 28 April 09. I applied under non-masters, regular processing, Vermont Service Center.
My attorny said it will probably take another two months before we will know if my case is approved. I’m guessing it will probably be sooner as they are sending receipts out very early this year.

Dude what cheque are you talking about? Cheques are with USCIS, we cant get the cheque with receipt numbers. That is sent to the attorney
I meant if you have given cheque from your personal bank account to the attorneys, towards your share of expenses, bank keeps a scanned copy of your cheque back and forth on the online banking website, after it is presented for encashment.
You should then be able to login to your account and see the receipt on the back of your cheque.

Yes I had regular processing Masters cap. Applied through California Service Center. I work for a publicly traded Internet company. I got an approval on Friday 24th April(CRIS email). The receipt date from USCIS was Wednesday April 15th. So it took a little longer than a week.

I’m actually a little bit confused about the form I-129 and I-797.
When my case status says:
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Approval notice sent.
Does it mean my case got approved? I looked at NAFSA website about “Practice Advisory: H-1B Cap-Gap For F-1 Students” and it says in order to get the data fix on I-20 the student needs “For a receipted or approved H-1B petition: A copy of the Form I-797 and/or the I-797 receipt number. ”

You apply for a new H1b asap from a different employer with the current employer’s receipt notice and pay slips. I think until your present employer’s H1B is not approved, your new application will still be considered under the cap.
You can absolutely transfer your H-1B to another employer.

I am outside the US and have applied for the non-masters H1B cap under premium processing. I havent received the receipt yet but going through all the coments I feel USCIS has processed the applications for Advanced degree holders under premium processing first. I have the following queries
1. What is the starting date for the 15 day Premium processing window

I just checked information on Premium Processing from the USCIS web site.
“Premium Processing Service provides faster processing of certain employment-based petitions and applications. Specifically, USCIS provides 15 calendar day processing to those who choose to use this service or USCIS will refund the Premium Processing fee and the relating case will continue to receive faster processing.
The processing period that is used to determine whether or not USCIS meets the 15 calendar day period will begin when the current version of Form I-907, Request for Premium Processing Service, is received by USCIS at the correct filing address noted on the form. Within the 15 day calendar period USCIS will issue an approval notice, or where appropriate, a notice of intent to deny, a request for evidence or open an investigation for fraud or misrepresentation. If the notice requires the submission of additional evidence or of a response to intent to deny, a new 15 calendar day period will begin upon the delivery to USCIS of a complete response to the request for evidence or notice of intent to deny.”
So apparently it’s 15 calendar day. And it seems the starting date is the date when USCIS received the application. In my case, I guess it is April 9.

Apparently my case was recd on April 15th (CSC Masters Quota regular processing) and the check was cashed. I must say I am very surprised at their quickness, but they be getting to the regular quota now. Needless to say, I am anxiously waiting for approval now. Does anyone know how long it takes the USCIS to get to the next step i.e, sent out Approvals/RFEs after receipt notices are issued?
If what you say is true, there can be 2 things.
Either your employer filed for PP or you r the luckiest one to have USCIS issue your receipt by mistake. I know atleast 20 ppl who applied through CSC including me through Non-PP and our applications reached CSC on 1st April. Still none of us has a receipt. Lucky huh!!! Congrats and best of luck.
Hi Vicki, I know for a fact that my employer did NOT do premium processing. The actual receipt has not reached my lawyer yet. I got the receipt # from the back of a cashed check image. I was actually prompted to check if the application fee check had been cashed or not by a friend of mine in Nor Cal who had her check cashed as well.
So for people with CSC non-premium, if you have a way to do so, check to see whether your check has been cashed or not. You can get the WAC # from the back of the check. Usually banks have images of front and back.
The only way I know is because I paid the application fee from my own checkbook. The rest is of course paid by the employer.
And just to clarify – my non-pp, advanced-degree quota application did reach the USCIS on April 1, 2009

I have an interesting story. I am working for a big company based in the US in the field of entertainment.
I am on OPT, undergrad. My H1b application (premium processing) arrived on April 1st. Last Tuesday my Attorney received my WHOLE H1B application, without being even reviewed stating that the FY 2009 cap had been filled. YES, USCIS confused my application for an application for last year and returned it without looking at it. My Attorney IMMEDIATELY wrote in red on the letter that, as stated on my I-129, this was an application for FY 2010 starting on 10/1/09 and that the application had been returned in error, and sent it back to them (priority overnight). The package arrived back on Wednesday. As you can imagine, I was freaking out and thought my application would not reviewed as premium processing and I would be back in the waiting game.
This was not the case, they still considered the receipt date April 7, 2009 and approved my application on FRIDAY, less than two days later after received it back!!!! Hope everyone here hears of the news, sooner than later.

I have been checking the USCIS website about 5 times a day since April 14th (when our lawyer sent me the receipt number) and the website status wasn’t updated until today, Sunday April 19 even if it says they approved my case on Friday, the 17th. I would have known since I’d been checking so often. And I figured nothing would happen over the weekend, LOL.

I cant believe it. This year was my third try… i got rejected twice and had to go back to school for the whole while. Things worked out,,, and thank god i am near completion of my MS and i got my h1 this year.

I got my petition aproved through premium processing, master’s degree. I can read this online: On April 10, 2009, this I129 PETITION FOR A NONIMMIGRANT WORKER was approved and we sent you an e-mail notice. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.
Since it was done via my employer’s attorney, I didn’t get this email.
Is this approval the final step? Am I all set and good to go then? Does anyone know what’s next? (I’m currently under OPT, already in the US…) any comments will be appreciated, thanks!

H! may anybody answer me, when will a receipt notice or case number given by USCIS???? accdg. to my employer they have filed me last April 1st but I guessed under regular processing maybe coz upto now I have not heard from them… thanks!!!!
At the End of May or 1st week of June. Don’t worry, you are not alone. None of the Regular Processing applicant has received receipts from USCIS. They take 2-3 months to send receipt or approval notices (if approved) to “Regular Processing” applicants.

Correct. We have to wait 2-3 months to receive the Receipt number and Approval Notices (if approved). FYI, USCIS doesn’t take much time to approve/deny the application once they assign a receipt number to the application.
My wife’s H-1 b was approved today under premium category(Application was submitted on Apr 2 2009 ).

I am very worried.
My potential employer applied through a lawyer and the application was received by USCIS on April 2. It was likely filed under Premium Processing but I am not sure. Still, not even a receipt so far and I hear of people getting approval notices! Are any other Premium/Regular applicants still waiting?
I am on a F-1 visa and hold a master’s degree from the US received several years back. My potential employer is a small, 4-person financial advisory firm that was started in 1991 (18 years back) and has net yearly income less than $2 million.
I don’t have financial experience and my grades in school were rather low. But still they decided to extend me an offer. Would this bother USCIS?
I am very worried.
Company Income is fine, But if the Job Require the applicant to have some knowledge of Finance, and you don’t have any degree in Finance, USCIS may issue a RFE (Request for Evidence) notice.

I have an undergraduate degree and have been working for a large entertainment multi-national company. I applied through the company for H1B on Premium Processing. I have been following this blog and was on cloud 9 because my application was received on April 1st
My lawyer received my package returned yesterday, stating that J-1 students are NOT eligible for H1Bs. However, I am an F-1 student! My lawyer sent the application back to immigration with another copy of my F-1 visa, reiterating that I am indeed an F-1 student and thus eligible for the FY 2010 H1B, and that the package being sent back was a mistake. Has this happened to anyone else? Am I completely screwed now? Any insights on this, especially from those that have applied within California, would be greatly appreciated.

My application was also filled on 1st April under “Regular Processing”. USCIS will process “Premium Cases” first and then “Regular Processing” cases. They have a Time-Frame of 2 months to process “Regular Cases”. So all “Regular Processing” cases will get receipts around last week of May or 1st week of June. So chill and relax and hope for the best.

Yes, If the case is filed under “Regular Processing” wait for 2-3 months to get a receipt. You will receive the receipt at the End of May or 1st week of June. Don’t worry, you are not alone. None of the Regular Processing applicant has received receipts from USCIS.

Mine is also Regular Processing. HSB Rocks is correct, First USCIS will process all “Premium Processing” applicants and then “Regular Processing” applicants. As far as Regular Processing time is concerned, I think applicants with “Regular Processing” will receive receipts and (if approved) approval notices only next month. According to USCIS time-table they have 2 months to process “Regular Applications”. So, chill guys, and hope for the best. If you application is correct and complete you will surely get your H1B approval notice by last week of May or 1st week of June.
While H1B stamping, does IT returns of previous two years required?

Sheetal, Even if USCIS approves your H1B, you need to attend a H1B Visa Interview at your nearest US Consulate. During the interview, the Visa Officer will check your certificates and degrees as well as your experience and make sure you are a genuine candidate. If everything looks ok to the Visa officer, he will Stamp “H1B” Visa in your Passport (you will receive your Passport after 2-4 days after your interview via Courier at your Residence) and then you can fly to US in September to join and start working with the company on Oct 1st 2009.

Well lets see now since my application is filed thru regular processing once recipt number comes it will be really like something to look forward to. Yes, The Visa Officers are highly trained. They can detect fraud candidates quickly. And the Visa Officers are always American Citizens not Indians. I do have a B1/B2 Visa so I know. They will check that your Degrees are from Reputed Universities (Just FYI, there are many fake universities in India and UGC recently issued a list of fake universities in leading newspapers in public interest). During an H1B Interview always present yourself confidently and professionally, and you will easily get the visa (of course if your documents are correct/genuine).

ALL docs are fine but previous employer is sick. Do they verify with previus employers in that case i know i wont get visa coz like many others with exp should know that employers dont like some one to see sucessful. How is that back ground check done do u have any idea.
Sheetal, To prove previous experience, all you need to have is “Experience Certificate”. They won’t call your previous employer. Don’t Worry…!

I just got my receipt today from my lawyer 04/13/09 (I think the actually date that receipt was issued was 04/11/09) and when I just checked my status again it said they have approved my petition today 04/13/09. That was fast!!!

Even though I m doing my masters, i applied using my Undergraduation degree as I have not graduated from my masters. I really dont think that matters. I guess it also depends from case to case and the company which is applying for Visa.

Well things are progressing so far. I too received a receipt finally. My lawyer filed as Premium Processing at the Vermont Service Center.
“On April 10, 2009, we received this I129 PETITION FOR A NONIMMIGRANT WORKER and we e-mailed you a notice describing how we will process your case.”
So, it looks like they must have quite a back-log of cases, since I know my file reached the Vermont Service Center on April 1st.
Can anyone tell me what does it mean:
I received my receipt today and it has Received Date as April 07 and Notice Date as April 09.
But when I check online its as below:

I thought TARP bank cannot apply for H1b, if they laid off at least one regular employee person in the last 90 days or smth. Isn’t the case?
TARP Companies can apply for H1B if they have enough documentation; New H1B rules doesn’t prevent them from applying, but it added more restrictions so companies have to provide additional documentation. If they have a employee with unique skills that they could have applied for H1B.

Two weeks seems not right.
As I remember, last year it was last week of May – first week
of June (for normal processing). This year the number of approvals
to be about the same. So I would expect similar timing.

On the USCIS site you can find “Case Status Online” menu and “Case Status Search” sub-menu.

If you have access to electronic copy of canceled check, look at the back side. There should be your receipt number.
This is your receipt notice. It means they got your case and it is in process. Did you do Premium Processing?

Is attorney who was preparing the case representing you or your employer? If you – then ask him for the copies of all paper work that he submitted to USCIS. If you are using your employer’s attorney, he usually mails all original paperwork back to your employer for you files. Check if your boss got those papers; it should be sufficient confirmation for you.
